        The investigation of the ongoing use of Plucker source in the
Bluefish/MercuryGuide/TechXNY/etc. products is still ongoing. We're persuing
several avenues of discovery through our attorney. Not much more I can say
on that yet.

        They are using Bluefish as the viewer, and have their own custom
"appicon" (using the 'Plkr' Creator ID) to tap on from the Palm launcher,
which spawns Bluefish (the viewer based on Plucker) and views the
Movies-Content.pdb file (also with the 'Plkr' Creator ID).

        We have contacted MercuryGuide several times and "urged" them to
change the Creator ID to something unique, and they have completely ignored
us. They are also ignoring requests for the source to the application for
which they distribute binaries of (Bluefish's modified viewer) Each time we
contact MercuryGuide for resolution, we are threatened with being sued by
the CEO of Bluefish.

        We're not giving up. This will sort itself out. I, for one, do not
feel "threatened" by anyone, the least of which a CEO who reacts to queries
about his license compliance with threats of lawsuits.
