Isn't the wording that he has to provide source, if asked?
So, as long as no-one asks, he's not in violation of the
GPL, right?  ;)

(I would guess that it would be a large pain for him to
 provide source, so as long as the source gets released
 in a short time, I'm happy to let it ride.)
