I agree. And the CD burner is ruled by technology. It's still another technological constraint that can be circumvented. I do believe the Schneier article had a very good point: technological constraints do not last. (Although I'm veering slightly off-topic,) I attended this year's Nokia Forum at the New World Hotel. Was quite interesting-- they brought up the topic of OMA DRM in the upcoming Series 60 v2 platform, as well as existing OMA DRM support in the Nokia phones. Essentially another technological constraint-- the DRM is enforced by the phone via a DRM descriptor file of sorts (downloaded with the content). I asked the speaker, what's to prevent a professional pirate from circumventing the DRM? Essentially his answer boiled down to admitting that there isn't anything to stop the pirate.
