Well, not Apple but the App developer.
Yes, that's possible, but it's why I said "yes, but". Over WiFi, it
will work as long as nothing gets in the way between the iPhone/iPod and
the server (routers, firewalls,...)
Over 3G, it would also work, but only with a limited bitrate, which
means that _in this case_ the server would have to transcode, which
doesn't work with all servers.
