A client of mine had many hours of legal wrangling when they discovered that
the RF(from a big library) image they had used on the front cover of their
magazine lacked copyright clearance. I believe the wrangling is still going
on. Where lies the responsibility? The image in question was an internal
shot of a building in Eire. Which, though public, was privately owned. The
image must have been taken with the knowledge of the owners. More money for
the lawyers!
