Sounds like you cracked it! I missed the box for the modal step by the
action name! 

There is still a problem though and it's not cured by checking/unchecking
the modal dialog icon. If you check it and run the action, the Contact Sheet
dialog will appear but it will have the settings for the last used contact
sheet. That means you cannot hop from one custom contact to another and also
have the option of changing just one of the settings; for example, change
the source from folder to browser but leave the other settings intact.

I think you will just have to record a separate action for each setup or
record one action with several setups and just tick off the sections you do
not want to run. Probably cleaner to have separate actions, IMO.
