Whoops, I cleaned this up a little. 1) USA democracy cannot survive under the coexistence of two equal, but separate highest laws of the land, (eg The Patriot Act and The Constitution). Over time, either the Patriot Act or the Constitution will prevail. If the Patriot Act prevails, Americans will be ruled by a fearful, paranoid government with all the tentacles that implies like secret police, surveillance of ordinary citizen, forfeiture of human rights and freedoms, loss of the right to due process, and loss of the right to privacy.
2) I have no problem with using generally accepted international law in making rulings on constitutional law. Everything should have its place, but the constitution and its legal precedences should carry the most weight. Leland F.
