Vehicles up to 3500kgs Gross Vehicle Weight (M1 Vehicles) can only be 
fitted with European Type Approved towbars if the vehicle has received 
European Whole Vehicle Type Approval. 
Non M1 vehicles, Light Commercial Vehicles and private imports from outside 
the EEC are not required to use Approved Towbars. "

The key facts seem to be that the legislation only applies to vehicles 
which have received EU Type Approval and which are manufactured post 1998. 

Any tow bar you make would now be tested under the MOT (change in 2012). 

I say go for it, I'm sure you'd make it suitably strong for the job.
