I think only REAL can answer that, because if it contains components from mySQL AB AND REAL has not secured a license from mySQL AB, then it's a problem, esp if its from their more recent IP. The plugin itself is not the database - if you wanted to deploy a copy of a mySQL server, that's also a separate issue. Vendors who incorporate mySQL AB's driver components need to enter into agreements with mySQL AB. Its likely that REAL has done that and paid for it.
