I don't know the licensing details of MySQL on OSX Server (even
though we have numerous XServes) but when I raised the situation of
running a commercial RB app on an existing MySQL/XServe install they
(MySQL) basically said I still need to buy a license.
I heard that on some MySQL training (not done by MySQL AB, though.)
Apple itself is quite unclear in
http://developer.apple.com/business/macmarket/mysql.html - it mentions
two licneses and hints that Mac OS Server does use SQL Network and
not (free) MySQL Community Edition, but does not say anything
specific.
As the article mention GPL license several times, I assume you are
right and this is the MySQL license Apple uses.
