Hmmm... I actually didn't know that (tells you how fast an
ex-internet-CTO can get out of the loop).  Certainly gives me pause and
makes me wonder if I want to support them any further.  What about M$'s
DRM?  I'm fairly sure they've licensed that to other vendors, no? 
There has to be a way to blend the ease of on-line music purchasing and
distribution with the SB3 type of output device model.  Too bad
itunes.com has so many, um, tunes.
