Dear Mr Kapoor The CIC is also bound to enquire into any complaint whose ground is 18(1)(f) "in respect of any other matter relating to requesting or obtaining access to records under this Act."
So if IC(ANT) failed to follow the law in your case "to malafidely prevent your obtaining access to records" - a Complaint does indeed lie to the Chief Information Commissioner - Mr Wajahat Habibullah to take action, but you waould have to address this to Mr Habibullah by name in his official capacity as C'IC. After this a refusal to enquire into your complaint would have to be signed by Mr Habibullah himself or another junior officer as per a specific direction from him. For example when a similar complaint was made to Chief Justice of Kolkatta High Court recently, the CJ withdrew all case allocations to a particular judge. A similar situation arose in the SC a few years ago too.
