What is the differance between statutory and non statutory 
complaints/representations. What criteria is used to classify them as statutory 
or non statutory.

Dear Mr Singhal

1) The State is not obliged to take heed /notice / action on your 
"non-statutory" complaint / representation. The normal Office / Secretarial 
practice /norms / procedures ensure that all 'dak' received is duly circulated 
to those concerned and filed away - this seems to have been properly done in 
your case. Sometimes they are required to send you an acknowledgement of 
receipt. Many states have implemented Public Grievance Commissions / Offices - 
you can approach them in such "non-statutory" matters. For Statutory Complainst 
on the other hand, there is a whole regime of time-bound systems to resolve 
grievances of those affected - these are also known as "alternate remedies" to 
be availed prior to filing Writs.

2) It appears that you are "misusing" RTI Act for your 3 year old complaints 
(which appear to be non-statutory complaints / representations) . At best RTI 
Act allows for disclosure of 

"4(1)(b)(vii) - the particulars of any arrangement that exists for consultation 
with, or representation by, the members of the public in relation to the 
formulation of its policy or implementation thereof;"

This is all you are allowed to know.

This information is to be proactively disclosed on website of the P/As 
concerned. In case of non-publication, you can approach the High Court for your 
State directly.
