  It is important to bear in mind that many sellers are not scale modelers. The 
figures would certainly be acceptable to many Flyer and hirail people, many of 
whom use all kinds of oversize toy figures and vehicles. In fact, A.C. 
Gilbert's own figures were over sized, IIRC. Calling them "S Gauge" rather than 
scale can be a good hint that they may not be correct for "scale" use.

  Currently the S scale section of Ebay is pretty well overrun with HO Woodland 
Scenics stuff, some 1/43 or larger trucks, and other items not of any use to a 
fastidious modeler.

  In the die cast area, almost all Matchbox and similar vehicles are listed as 
1/64, although they were "box scaled" and some trucks are closer to 1/100! Some 
folks simply don't understand that the scale represents a ratio, or what that 
might mean. I've encounter people on various Yahoo groups asking if two objects 
are different sizes in real life, should they be the same size in 1/xx scale?!
