Mohib, I'm flabbergasted after hearing your sole resentment with
public bodies to sue them in courts.
Better you reflect the terminology 'private' and ponder upon questions
like what is private? organisation/institution which is not
government-undertaking is private? and so called NGOs like NAB, NFB
and others who  claim to cater the needs of members in thousands have
no obligation towards the constitution because they are private? such
narrow interpretation is detrimental for disability movement in India
which is still at a nascent stage.
When in family of two, husband's brutality on his wife is not private,
then how NGO like NAB which has its branches in most parts of India
can claim to be private and go on exploiting and discriminating
persons with blindness?
And I wonder if you understood what I meant to send across in my
previous mail , let me delineate little further.
You must have read legal positivist HLA Hart, Jurisprudence does not
only deal with legal text. And judges apply their own rational faculty
to ensure justice to aggrieved. And judges go beyond legal texts is
palpable by various judgements. remember, pain is invisible, it has no
voice, it can't be expressed in court, it can only be beared and
experienced.  and previous advertisement inflicted psychological
profound pain. Further many disadvantaged people have been benefited
not because of existing laws, but because Judges have applied their
rationality in interpreting laws in better ways. so thatNab on its
website says: We Help the Blind Help Themselves.
What will the say in Court if this question will be asked? with regard

Further they say: We have also provided our Reports - including the
financial statements; we believe in absolute transparency in terms of

 But yes one right which has been violated here, upon which every one
 has consensus, that is fundamental moral right! that has been of
 course violated!
 Thats the point upon which Assistant Menager RBI, Mr Asudani insisted
 that it has been violated. Right to equality and here in terms of
 employment, the right of equality of opportunity .
 If you read the title of Article 16, which reads as equality of
 opportunity in matters of public employment, itself suggests that it
 is available only in public employments and no private employment can
 be covered under the auspice of this article thus no person can claim
 violation of any fundamental right against such private body.

the first time has delved deep in to exposing painful experience of
women with blindness who reside in various so called private hostels
in the capital.
I've given the original title with some addation in the subjectline.
safe accommodation for blind women is the desperate need of the hour
otherwise, quality education and employment will remain distant dream
for majority of them.
This article is worth-preserving thanks again this will help me in my
research titled: Persons with Disability act 1995: a Study in Delhi
And Sanchit, I am pasting this article and sharing on other lists as
well for more wider readership to let people know the harsh realities
of life of women with blindness.
Article Begins
Seema had just one dream: an independent and financially secure life.
It took some time for this feisty visually impaired teenager from a
middle-class family in the northeast to convince her parents that she,
too, needed to go to school like her siblings. Finally, her father
packed her bags and brought her to a school-cum-hostel for blind women
in Vikaspuri, Delhi. Seema was happy and certain that she would become
a lawyer someday.

That was six years ago. Sitting in a dark, dingy room on the first
floor of a hostel for blind women, the political science student says,
“Perhaps what I wanted to do would just remain a dream.” It seems
Seema is not the only one with shattered dreams; her 36 hostel mates
apparently share her sentiment. Finding a decent roof above their
heads is what drains these blind women of their resolve.

Seema's hostel is a damp dilapidated building in Sant Nagar, Delhi.
While the food they get is far from palatable, the rooms are
overcrowded. The open gutters that lead to the hostel get flooded
during monsoons, making it impossible for people like Seema to
navigate their way. But what has hurt this 21-year-old most is the
attitude of people on the road: she says most of them try to take
advantage of her disability. “But what makes me so helpless is the
fact that I cannot even see them. Earlier, I was living a
claustrophobic life and here I am fighting every moment to keep my
self-esteem and my dignity intact. I want to fight, but ‘the war'
seems never ending. And I am not sure, if I can ever win it,” she
says.

Another hostel for the blind in Nathupura is home to six women who
study at Delhi University, about 15km away. Every day they have to
walk a kilometre and a half to reach the highway, cross the road to
board a shared auto-rickshaw and then take a bus to the university. It
takes no less than an hour and a half and they need at least three
‘considerate' people who can help them cross the road and board an
auto-rickshaw and the right bus.


The daily ordeal apart, their hostel is dingy and reeks of rotten
food. The rooms are dirty, and a bed and an open shelf count as
furniture. The staircase to the rooms on the first floor is narrow. To
add to this, the windows are not covered, denying them privacy, says
an inmate. The rooms get overcrowded during the summer holidays when
other college hostels close for vacations and their inmates, too, come
here.

Every year, around 500 blind students seek admission at Delhi
University, which has 15 per cent reservation for students with
disability. But unfortunately, the university hostel has just 3 per
cent reservation. Also, the annual charges for the hostel mess ranges
from Rs.35,000 to Rs.80,000, which is not affordable for many. In all,
there are about 1,500 disabled students studying at DU. Of these,
hardly 200 students live in hostels provided by colleges. The rest are
left to fend for themselves.

Surprisingly, the government does not have any provision to provide
accommodation for blind women students. (The state runs Seva Kutir for
blind men.) This has led to a spurt in the number of hostels for women
by NGOs, most of which are not registered under Section 56 of the PWD
Act and are located in underdeveloped areas like Sant Nagar, Begampur,
Nihalpur, Rama Nagar, Burari and Nathupura.

Lalita, a political science student, stays in one of the hostels in
Burari, run by a blind couple. She pays just Rs.500 a month for the
accommodation and food. But there is problem, she says. “They expect
us to go for these fund-raising exercises on holidays. They are not
concerned about our studies. We are expected to go to such events even
during exams,” she says.

In their defence, the people who run these hostels say they are
hard-pressed for money and cannot do any better than offering the
women a place to live. “I sell timetables at the old Delhi railway
station and earn Rs.3,000 to Rs.4,000 every month. To run this hostel,
I get funds from local businessmen. I need at least Rs.15,000 to run
the hostel,” says Ranjan Kumar, 35, a former Delhi University student,
who is also visually impaired. “With this money, I can't provide any
better facilities.

dear friends,

today my desktop pc is not working well. when I started it it shows
some problem.  it inquires how to start, a number of options are
there, safe mode, safe mode with cmd, normally etc. when I hit enter
on normally then it shows the next screen and displaying the message
that preparing desktop and then black screen appears and cpu sound
decrease and on touching it, it seems that as if it is off but some
noise is coming from speakers. when I started it in safe mode then the
computer started but there was no jaws. I installed audio.reg to
activate audio in safe mode but still no sound is there when I opened
jaws, it showed error of display driver and after hiting ok on it,
nothing was done. wsame is the case with NVDA. can you people guide me
what to do to restore it. I don't think that I have any restore point
created because I don't know how to create one and use one. I have
some idea about it but never tried. also, when this problem happened ,
I recently have not installed any new software etc. the only thing
which I done was that I  pressed the power button by mistake and the
pc was running. it asked that 5 programs need to close then I realize
that I should cancel it. I canceled it but when I tried to continue my
work then it shut down automatically. and then all this error is
showing on again starting it. presently I am writing this mail from my
laptop.

Firstly, I applaud use of the Accessindia forum for such constructive
initiatives.

 

As the discussion around this topic is evolving, I imagine that many of us
may be presently considering getting an insurance policy. If any of you are
interested, I would recommend my agent, who himself is disabled, for
consultation. You  may finally avail services of your existing/ preferred
agents for getting the policy, but having a conversation with my agent may
help you gain insights into regulations/ procedures for getting a insurance
policy for a disabled individual.

[AI] Require urgent help regarding degree studies in science stream

Dear friends,

I am writing this mail for my brother. He has passed +2 science with more than 
70%. When we tried for an admission for B.Sc Computer Science, in M.G. 
University; they said that science courses are not permitted for VI candidates. 
We are trying to change this rule. Is there any government circular/rule which 
clearly states that VI can pursue science for graduation? Is the same 
restriction existing in other Universities also? Please help me urgently since 
the admission closing is nearing.

Hi,

You can use the MSJE's list of identified jobs. Computer Science is
one such job that has been identified as suitable for persons with
blindness or low vision.

Now a days, most of the companies are launching the online products
including term plans/health insurance plans. Means, we can directly by
the insurance product from the respective company's website without
involving the agent. These online plans can be purchased with very low
premium rate as compare to regular plan since the agent's involvement is
not there.

@doris,

what is the fix for audio in safe mode? I have one registry file for
that. are you talking about that fix? activate audio in safe
mode.reg.  nvda and  jaws both are running but give no speech output.
 I haven't reset any setting regarding restore point. this problem
appeared in the morning at about seven a.m. and now it is about to
4p.m. so should I go to restore it from restore point? throw some
light on that please

Hello all,

We should learn how to talk to our senior and respected members.
Arguing like a street boy and using the foul language such as crying
and sort of things is intolerable.
I’m replying because I’ve so called cried over the advertisement. I
wish professional degree must have taught some professionalism, some
mannerism and how to express oneself like a professional.

Mr. Rajesh asadani is our very senior and respected member and I
strongly condemn such language against him.

We should not forget that we have been taught to apply the law in its
letter and spirit both and not in the letter only. The concept of
Fundamental laws is an ever evolving and dynamic concept. If my legal
knowledge is correct, I think that Article 21 of our constitution
relating to life and personal liberty comes under the fundamental
rights enumerated in part 3. The Supreme Court judges were not fools
who delivered various MC Mehta landmarks judgments against erring
private entities by applying the concept of fundamental rights of life
and personal liberty!

It is ok each and everyone introducing their agents. But in which, there is
a clarification. Usually, LIC agents will give us first three to five
premiums to their clients. But none of you are telling how many premiums
your agents are willing to give at the beginning?

I guess that could be useful for deciding whether to approach that agent or
not. We all look for the best, though.

nothing was done. wsame is the case with NVDA. can you people guide me
what to do to restore it. I don't think that I have any restore point
created because I don't know how to create one and use one. I have
some idea about it but never tried. also, when this problem happened ,
I recently have not installed any new software etc. the only thing
which I done was that I  pressed the power button by mistake and the
pc was running. it asked that 5 programs need to close then I realize
that I should cancel it. I canceled it but when I tried to continue my
work then it shut down automatically. and then all this error is
showing on again starting it. presently I am writing this mail from my
laptop.

It will be advisable to read the fine print in such cases. 
There are so many discrepancies  in giving insurance to blind persons within
the same company.

Unfortunately we cannot have the peace of mind that the claims will be
settled properly when required. It looks like the insurance companies will
try to find all excuses in case of persons with disabilities for not paying
the insured amount.

In our case LIC issued policy to my wife without any condition whereas put
several conditions in writing in my case.

Someone needs to get the courts involved and get a clear cut policy
declaration from the insurance companies or the IRDA for persons with
disabilities.

including term plans/health insurance plans. Means, we can directly by the

The JAWS does not work fluently in my laptop as it runs on my desktop.

i face issues in applications like internet explorer, mozilla firefox,

thanks friends. I installed a new copy of windows. actually still
sound is not coming out of speaker. I think at that time also the
problem was about some drivers. don't know how these drivers were
automatically uninstalled. with window seven I never thought of
installing the drivers because it updates drivers by its own. but this
time, audio driver was not upgraded. as far as safe mode is concerned.
I had not used nvda but jaws was working very well like normal. in
this case sound was not coming from speaker I thought jaws is not
working well but when I plugged head set with my pc then sound was
coming from these speakeers. so, safe mode is safe with jaws, this is
what I understood after this bad experience. and I will encourage all
of you to install activate audio in safe mode . reg because it allows
audio to be played through head phones in safe mode. thanks!

Hi members as in all government establishment minimum 3% reservation
has to be provided but here again State of Uttar Pradesh has flauted
this basic rule by not providing reservation in PCS judiciary in favor
of physically handicapped persons. Last year they did the same against
which I filed a petition under Article 226 in Allahabad High Court as
Mohib Anwar versus State of Uttar Pradesh and Anr. where in Public
service commission is also a party.
Last time even they denied to accept that a physically handicapped
candidate is eligible to sit in the examination in reply of RTI filed
by me, but this time after few hearings of the case they have given
few relaxations, such as they exempted the fee in favor of PH
candidates, they provided age relaxation, but they have clearly
written that PH candidates may apply only against unreserved
vacancies. It mean there is no reservation.
I am going to challange this advertisement in next hearing of the case.
Well what is the good way to claim indipendence of judiciary!

 PRINTFONT SIZEBhopal, May 21: Beating all odds, a visually impaired girl, 
Shrishti Tiwari, from Damoh town has topped the Madhya Pradesh Higher Secondary 
examination in Arts stream.

The results were declared two days back by the Madhya Pradesh Board of 
Secondary Education.

For Shrishti, a student of JBP Government Higher Secondary School in Damoh, the 
achievement is special not only academically but also because of the fact that 
she is visually impaired since birth.

She scored 481 out of 500 marks to emerge as the topper in Arts stream.

Shrishti's grandparents and uncle helped her a lot in mastering the subjects, 
her family said.  While her parents stay in Bhopal because of job compulsions, 
Shrishti's maternal uncle Sanjay Gangele prepared notes for her.

Her maternal grandparents Virendra and Pushpa Gangele read out the notes to 
her, they said.

In High School examination also, Srishti had secured a place for herself in the 
merit list in 2011, they said.

to share  your mobile internet connection with  the laptop or pc , do
the following:
first connect  your phone to pc/laptop  and choos connect pc to web
mode from your phone. it'll install a little application to your
computer.  install the application using jaws cursor, after a few
minutes,   the application will present  the connect button.
if this doesnt works, ( some times doesnt works with all nokia
phones),  connect the phone to pc suite  mode, and choos connect to
the internet  threw tools menu in the ovi suite application.  the
interface is   inaccessible, so you might need to take help or you can
also use OCR its some how works.
choos the cuntry, and then the carrior and hit the connect button.

hi friends,

I want some suggestions related to my blog. I have made a blog on
blogger.com. if anyone has used blogger.com's blog then any shortcut
keys or any refined way to do  some task etc which you learned from
your experience then do share it because with jaws there is no help
manual and your experience will help me a lot for sure. and also, want
to ask a question that in blogger.com all of my posts' text  are
displayed on one page. I want to customize it In a way that beginning
some lines are present on the main page and if someone wants to read
that topic then he hit on the heading link or read more link or
similar some link. I don't know in blogger it is possible or not. if
it is possible then please tell me how. also, if I want to apply some
effects on the text I wrote in the edit field with the help of the
buttons given above the edit field while creating the post then how I
will do so. I will select the text on which I wanna apply the effects
and if shortcut key is available then will press it but most of the
time these buttons have no shortcut keys. in this case what would be
the procedure. thanks!
