Shona, I have had quite a few cases where the Hon'ble High Court asked the petitioners to withdraw the writs since they did not explore the institution created under the Disability Law i.e. the CCPD/ State Commissioner- Disabilities. Also it is advisable to have the order from the CCPD/State Commissioner. If that doesn't work, then you have a stronger case in the High Court since you are armed with a judicial order that has been passed by a court of competent jurisdiction. This is not to discourage you as many courts have accepted the petitions too in absence of any opposition from the respondents. yes sir the matter is urgent, the prilimnary exam is to be held on 13 May 2012, and they are not allowing me to appear in this exam. I have left with no choice, but your suggestion is very valid, before going to high court next week I will be sending the complaint copy to the CCPD and commissioner of U.P. Dear Shona, This is outrageous. Several states continue to discriminate against persons with disabilities and have not bothered to change their recruitment rules despite several reminders. They don't understand the language of representations and letters. However, they do act on court orders which is very unfortunate part of governance in certain states.
