Shona,
I have had quite a few cases where the Hon'ble High Court asked the
petitioners to withdraw the writs since they did not explore the
institution created under the Disability Law i.e. the CCPD/ State
Commissioner- Disabilities.

Also it is advisable to have the order from the CCPD/State Commissioner. If
that doesn't work, then you have a stronger case in the High Court since
you are armed with a judicial order that has been passed by a court of
competent jurisdiction.

This is not to discourage you as many courts have accepted the petitions
too in absence of any opposition from the respondents. Also if the matter
requires urgent order then it is advisable to go to High Court and state
the urgency.

yes sir the matter is urgent, the prilimnary exam is to be held on 13
May 2012, and they are not allowing me to appear in this exam. I have
left with no choice, but your suggestion is very valid, before going
to high court next week I will be sending the complaint copy to the
CCPD and commissioner of U.P.

This is outrageous. Several states continue to discriminate against persons
with disabilities and have not bothered to change their recruitment rules
despite several reminders.

They don't understand the language of representations and letters. However,
they do act on court orders which is very unfortunate part of governance in
certain states. However, this needs to be taken up with the Hon'ble Court
of Chief Commissioner. fortunately we have a dedicated and efficient Chief
Commissioner in form of Mr. Prasanna Pincha and a complaint along with the
details of advertisement should be sent to him at the earliest.

[AI] PH is not eligible to appear in judiciary exam!

Friends last month Uttar Pradesh Public service commission advertised
for the recruitment of civil judge junior devision through an
advertisement. No reservation was given for physically handicapped in
this recruitment. However some of our friends file an RTI asking the
reason for the same, luckily they replied and they replied that PH is
not eligible even to appear in the examination.
Here I would to remind the members that in December Delhi conducted
exam for recruitment of civil judge where they kept 5 seats reserved
for blind/low vision, and recently in Haryana one visually handicapped
has been selected as a civil judge, more over all other states provide
reservation in PCS Judiciary exam.
Friends what to do now?
