I remember you mentioning in a separate mail that VI people pass their bank
exams by taking undue advantages of scribe and here you are mentioning that
what if your scribe dies due to COVID. How ill can you think of the person
who would have thought to support you to achieve your dreams? Also, if
other VI person passed their exams because of their scribes ability and for
you all the external factors are responsible for your failures.

Hi aman preet personally I haven't use their course but 1 of my friend is
preparing for UPSC with their pendrive course that's why I know their
videos are still accessible however their pdf files are not accessible
because my friend is unable to open pdf using keyboard however it works
well with mouse

Sambhavana organization is trying to file a contempt petition. But
since last two months they are collecting the money, and they are
saying unless you (the candidates who are interested in the case) give
us 50,000 rupees, we will not proceed with the case. So far as, the
contribution has reached to 31,000 rupees, and we are still waiting
for remaining amount, then the case will be filed!

The UPSC has always been defeated by the disabled people in the
Courtrooms,yet they continue to waste tax-payers money in court cases
for no reason. I'm sure they will lose once again and the Apex Court

 It says:  The number of vacancies to be filled on the result of the

 yes, it is mendatory to give particulars of the scribe whom
  you will bring. The particulars include, the name of the scribe,
 permanent address of the scribe, photo and the signature of the scribe
  and the declaration.
  The qualification of the scribe must not be more than that of a graduate.

  My problem is that, how can I say before 3 months of the exam that
 particular person would be available to write my exam at that time?
  They haven't changed anything in comparison to last year.

There are two points which need to be put before the court.
1. There must be at least 1% reservation for visually impaired on
total number of vacancies in all cadre. The same issue has been
decided on last year's PIL in the matter of Sambhavna versus UOI 
Union public service commission. To the best of my knowledge Delhi
High Court has disposed off the petition after necessary instructions
to the government and UPSC to provide 3% reservation on total number
of vacancies including 1% for VH.
2. In another petition Delhi high court had allowed visually impaired
candidate to bring their own scribe for writing mains exam . It mean
you can bring any scribe who is with in the prescribed qualification.
But again this year notification says that if you want to bring your
own scribe, you will have to provide the particulars of the scribe and
upload his photo and signature at the time of filling the application
form . Which is not feasible. As it would be difficult to give the
name of the scribe 3 months ahead to the exam.

So guys what do you say? Should we knock the doors of the court once
again? If members here are interested in taking judicial discourse, we
can come altogether and file a public interest litigation.
Let me explain, Why the petition is necessary.
A. The matter of minimum 1% reservation for visually impaired
candidates on total number of vacancies has already been decided by
the Supreme Court in 2013 in NFB v. Union of India case.
B. Last year in a similar case, Delhi and Bombay High courts have
given instructions to the government to provide the same.
C. It is difficult for us to give the particulars of the scribe at
this time as he may not be available at that time.
D. Presently only 5 vacancies are kept reserved for visually impaired
candidates. And 12 times of actual vacancies will qualify for next
stage, i.e. maximum 60 candidates will be called to write mains exam.
E. If they give 1% reservation, minimum 11 vacancies would be reserved
for us, by that way maximum 132 candidates will qualify for mains. It
makes huge difference. If you are disqualified at the preliminary
stage, there is no chance for moving forward.
That's why its very important that minimum 11 vacancies should be
declared reserved for us so that maximum could qualify for mains exam.

I heard that similar orders have been passed by Delhi high court too.
However we want prelims question paper in computer format from next
turn. Better if UPSC instruct the respective centers through a note
regarding the change in extra time.

Mam, has Bombay high court pronounced the final judgment? Because here
in Delhi, high court has passed interim order regarding extra 20
minutes and granted further time to UPSC to renotify the seats before
mains exam. Nevertheless the petition has not been disposed off here.

Kanchan mam, please include the relief to provide question paper in
accessible format(at least in prelims exam) for VH candidates. As it
would be easier to have question paper in computer format, since we
are used to it, and some times its very difficult to make a
coordination with scribe. We are also trying to nab UPSC here in Delhi
High Court, but really something has gone wrong, and the writ will
appear on cause list after sometime.

Thanks. I cant do much more now.
I wish you had mentioned it earlier.
What I have done so far is that I have filed a writ in Bombay High Court. It 
came up today but UPSC asked for time. It now will be heard on 22nd July.

I have challenged the vacancies-only 26 instead of 39
then for VI only 2
then the compensatory time
and no use of talking calculators and the qualification of scribe.

Lets get some orders against them and then go for more.

I am informed that the Delhi petition has been rejected at present but 
however it may get reinstated later on. Maybe they will have to amend the 
Petition.



I have lots to discuss about this matter but shall do so only after it is 
over. Its a learning experience for all of us.


Please do fill up your forms and do study hard.

Thank you. Yeah please include the issue of accessible question paper
next time through additional relief. Petition has been referred by
Delhi High Court to be renotified before regular bench after inclusion
of proper parties, it mean court want aggrieved persons as
petitioners. In such a situation in my view it has lost its PIL
status. But we will work hard when the matter will be again listed for
admission and then hearings before regular bench.

When is the Judgicial services exam?
The CCPD guidelines were drafted only after several High Court judgments.
These judgements are reconfirmed in the different clauses of the CCPD
guidelines. So apart from the CCPD guidelines of 2013 I would like you to
use these judgements as and when you file a case in Delhi. 

Let me explain- There were certain guidelines in 2003 from the CCPD. These
dealt with 50% marks etc for a scribe etc. 
People hated these guidelines. 

In 2006 Kishore Gohel cajoled me into appearing for him. We intervened in
the on going litigation. At that time there was a problem in Maharashtra-the
current CJI Mr. Lodha then in Bombay High Court had ordered all recruitment
in Maharashtra to be stopped till the Disabled quota got filled. To rush
through in whatever manner they could Maharshtra government conducted exams
where the writers were 4th standard students.   Since I was the blind lawyer
and I had intervened and I saw the other lawyers had no experience and the
government was pushing some rules, I had to draft. I remember a that time we
had to do it just outside the court room. Suhas Karnik and Ketan Kothari
helped and we got a fairly good set of guidelines through. This became the
standard for Maharashtra and tifferent people have used it across the
country.  
Then in 2007 Sisodia's case came up before CCPD. I appeared on 3 occasions
for him. After that the officer at the CCPD's office then Ms. Sunita Singh
realised the problem. The CCPD called a meeting of the stake holders CBSE,
UGC etc. in 2008. I had submitted a note based on the 2006 guidelines,
Dipendra's notes on computer based exams and the discussion on
accessindia.On the bases of the paper I submitte and the discussions at this
meeting in February 2008letters were sent to different ministries etc for
their opinion. Finally when there was no response from ministries etc Mr.
Pincha notified these guidelines in 2013.
While we waited from 2006 to 2013 we have had to go to Court on many
occasions. Many have agitated before Delhi High Court and I know that in
Mumbai it is constant. These judgements are with Amit Bhat, on the eyeway
and Pratik Aggarwal's website. These are what you should use if you are
going to court. 
I thought this problem would end after February 2013 but
 I must also tell you that even after 2013 once again Maharashtra decided to
issue its own guidelines. It took 4 dates in Court and lots of explaining
and a whole lot of paper work to get the Maharashtra guidelines in line with

Thats very importent issue. Rather I am going to file a petition in
Delhi high court against the High Court itself for implementing MSJE
scribe guidelines in upcoming Delhi Judicial service exam which is
conducted by the High Court itself. I talked to Registrar of High
Court, but he was of the view we can not implement these guidelines
because it will be difficult to ensure that a candidate isn't involved
in cheating. If I am able to get order from High court once, I can go
to High Court again against UPSC for proper implementation of these
guidelines or to do some favorable arrangements.

Thanks very much Kanchan mam. The exam is scheduled on 1st of June
2014. However Joint Registrar vigilence Delhi High Court informed me
that the decision of compitant committee upon my representation to
adhere MSJE guidelines can only be communicated to me on or after 15th
May, when this 5 judge committee will take this decision. If the
committee disapproves these guidelines, I will be having only a week
or so to file and be heard through a writ petition. Or should I file
petition in advance? But do I really have locas standi before the
decision of that committee? what do u suggest? I thought to file an
RTI to enquire about the scribe guidelines which they will be
following in such exam, but the RTI procedure of Delhi High Court is
quite stringent, as an RTI can only be filed in person.

Thanks very much Kanchan mam. The exam is scheduled on 1st of June
2014. However Joint Registrar vigilence Delhi High Court informed me
that the decision of compitant committee upon my representation to
adhere MSJE guidelines can only be communicated to me on or after 15th
May, when this 5 judge committee will take this decision. If the
committee disapproves these guidelines, I will be having only a week
or so to file and be heard through a writ petition. Or should I file
petition in advance? But do I really have locas standi before the
decision of that committee? what do u suggest? I thought to file an
RTI to enquire about the scribe guidelines which they will be
following in such exam, but the RTI procedure of Delhi High Court is
quite stringent, as an RTI can only be filed in person.

These judgements are reconfirmed in the different clauses of the CCPD
guidelines. So apart from the CCPD guidelines of 2013 I would like you to

Let me explain- There were certain guidelines in 2003 from the CCPD. 
These

dealt with 50% marks etc for a scribe etc.
People hated these guidelines.

In 2006 Kishore Gohel cajoled me into appearing for him. We intervened in
the on going litigation. At that time there was a problem in
Maharashtra-the
current CJI Mr. Lodha then in Bombay High Court had ordered all 
recruitment

in Maharashtra to be stopped till the Disabled quota got filled. To rush
through in whatever manner they could Maharshtra government conducted 
exams

where the writers were 4th standard students.   Since I was the blind
lawyer
and I had intervened and I saw the other lawyers had no experience and 
the

government was pushing some rules, I had to draft. I remember a that time
we
had to do it just outside the court room. Suhas Karnik and Ketan Kothari
helped and we got a fairly good set of guidelines through. This became 
the

standard for Maharashtra and tifferent people have used it across the
country.
Then in 2007 Sisodia's case came up before CCPD. I appeared on 3 
occasions
for him. After that the officer at the CCPD's office then Ms. Sunita 
Singh
realised the problem. The CCPD called a meeting of the stake holders 
CBSE,

UGC etc. in 2008. I had submitted a note based on the 2006 guidelines,
Dipendra's notes on computer based exams and the discussion on
accessindia.On the bases of the paper I submitte and the discussions at
this
meeting in February 2008letters were sent to different ministries etc for
their opinion. Finally when there was no response from ministries etc Mr.
Pincha notified these guidelines in 2013.
While we waited from 2006 to 2013 we have had to go to Court on many
occasions. Many have agitated before Delhi High Court and I know that in
Mumbai it is constant. These judgements are with Amit Bhat, on the eyeway
and Pratik Aggarwal's website. These are what you should use if you are
going to court.
I thought this problem would end after February 2013 but
 I must also tell you that even after 2013 once again Maharashtra decided
to
issue its own guidelines. It took 4 dates in Court and lots of explaining
and a whole lot of paper work to get the Maharashtra guidelines in line
with
the CCPD guidelines.
I hope you use all this material if you are going to file a case against
the
Judicial exams.
It is a bit too premature for the UPSC but I am tracking it.

Thats very importent issue. Rather I am going to file a petition in
Delhi high court against the High Court itself for implementing MSJE
scribe guidelines in upcoming Delhi Judicial service exam which is
conducted by the High Court itself. I talked to Registrar of High
Court, but he was of the view we can not implement these guidelines
because it will be difficult to ensure that a candidate isn't involved
in cheating. If I am able to get order from High court once, I can go
to High Court again

Nothing can be done in this regard, UPSC has been involved in flauding
the rules since its inception. I have no hope for any improvement,
however I have full faith in indian judiciary that they will delay the
case upto next year prilims! if u go under a writ.

Yes I do see the need for this since I understand from her interview
that she has got a good rank and she is thinking that she will get an
IAS posting. Perhaps she is not aware of the actual situation of
visually challenged officers. I am not from that area, but Dinamalar
states that she is from a city called Dhindivanam which is located in
the Vilupuram district. Since I am not in tamilnadu at the moment, I
would like to appeal to other access India members based in Tamilnadu
to help Kanchan in this extremely important matter. Dhindivanam is not
too far from Chennai and as I understand from her interview, she took
her coatching from a well recognized coatching institute in Chennai.
Come on guise from Chennai! Access India needs your help.

I need help. Can you find someone who can locate this girl. Actually track 
her down. We need to follow her story carefully. We need to see how the UPSC 
behaves and if she needs help then it must be ready for her on top priority. 
Every time we have been lax about the UPSC recruitment.


In Maharashtra I am seeing the problems. Every time a circular  goes 
unchallenged the government gets bolder and doles out more shit. With all my 
personal effort and with all the support I have from everyone not just the 
visually challenged, I still cant beat the system. The challenged do get 
discriminated against. The ground reality is too much to deal with.


So back to this young lady who has done so well. Lets stand by in readiness 
to support her because I am sure she will have hell in getting the service 
of her choice.

Yes I do see the need for this since I understand from her interview
that she has got a good rank and she is thinking that she will get an
IAS posting. Perhaps she is not aware of the actual situation of
visually challenged officers. I am not from that area, but Dinamalar
states that she is from a city called Dhindivanam which is located in
the Vilupuram district. Since I am not in tamilnadu at the moment, I
would like to appeal to other access India members based in Tamilnadu
to help Kanchan in this extremely important matter. Dhindivanam is not
too far from Chennai and as I understand from her interview, she took
her coatching from a well recognized coatching institute in Chennai.
Come on guise from Chennai! Access India needs your help.
