[PSES] California Prop 65

Just starting to dig into this - and haven't gotten to the legalese just yet 
but headed that way. But so far what I've read would indicate that it doesn't 
mandate removal of the chemicals - other than those already regulated such as 
lead a Cadmium it appears that after analysis is you are above the below the 
safe harbor numbers you are only required to put a warning on the product that 
carcinogenic materials are in the product. I've seen the warnings all over the 
place during my travels to California - Disneyland, and basically any place you 
can think of. I believe they have a contact point so the interested consumer 
could follow up should they choose, but certainly a warning can't be all that 
is required for the 800 or so chemicals listed. Is there no requirement for 
removal or reduction to the safe harbor levels?

No requirement to remove them. Appears to be a name and shame approach that 
has had some success in companies removing some chemicals from products. 

A few points: 
1. A huge portion of the 800+ chemicals have no established safe harbor levels. 
2. Enforcement is primarily by citizens or NGO type groups who buy products 
without warnings, test them to find any of the 800+ chemicals, then work with 
specialty law firms to sue you and reach what are in effect consent settlements 
that cover all of their attorneys' fees and then some. This enforcement 
mechanism is written into the law/regulations, and appears painful for those 
sued. 
3. California is in the process of improving the enforcing regulations, and 
issued proposals in April 2014. They got a lot of comments, and are presumably 
digesting those on their way to final regulations. I did not see these 
proposals as improvements, which is why I put the quotation marks around the 
word. 
4. Because of the size of the California market plus the common desire by 
manufacturers for one set of warnings for all products sold in the USA, this 
has impacts far outside of California.

Hi Amund,
The Europe the GSM frequencies for Europe are 900 MHz and 1800MHz bands.

The test requirement you are looking for has been incorporated into 
CISPR35 drafts will eventually be adopted into EN55035.  The 
CISPR35/FDIS includes a requirement for spot testing both 900 MHz and 
1800 MHz.  CISPR35 did not get approved in the most recent vote, but the 
issues raised did not impact these spot frequencies.  Instead, there are 
some debates about the levels required for radiated immunity at these 
spot frequencies for equipment marketed for use in telecommunications 
centers or central offices (30 V/m).  As long as the PC monitor does not 
have a network function that is intended for use in this environment, 
then the manufacturer can decide what protection distance the product 
must be immune to radiated immunity frequencies with 3 V/m for 3 meter 
protection distance being the easiest level to achieve.  The harsh 30 
V/m level is for the protection distance of 20 centimeters.  Personally, 
I encourage use of the half meter protection distance which requires 
being immune to 12 V/m.   All of this will be made clear when the 
CISPR35 is finally passes and the standard is published.  If desired, 
you can get a look at the proposed radiated immunity requirements by 
looking at Europe's non-harmonized standard EN50635 today.


CISPR and CISPR/I is meeting in Frankfurt during the week of October 
20th, and they will figure out a path forward to get CISPR35 approved 
quickly (I'm guessing 6 months).  Europe will likely publish EN55035 
about 3-6 months after that.  The bottom line is that the immunity test 
requirements you are looking for are coming soon

It my professional recommendation is that the Kalifornia wines be considered 
HAZMAT. Mr. Woodgate should pursue the local 'micro-brew' ales - the better 
microbreweries are in to the south in San Diego County.

And Mr. Woodgate will arrive in time to experience the end of a mild 'Santa 
Ana' - but temps should be under 38C. Good time to verify ESD immunity of your 
equipment.

First, my sympathies in that you have to go to LA: the Bay Area's weather will 
be much better by comparison. As soon as you leave Customs/TSA, consider buying 
a good bottle of California wine.  With the lead, sulfites   other 
unmentionables (Acetaldehyde, Dimethyl Dicarbonate, Trypsin, etc.) in the wine, 
you  your lead John, will look good by comparison!  And, you may be able to 
hail a taxi faster with wine in hand...
