[Audyssey] Article about Interactive Fiction for Spag magazine

Hi all,
I have emailed the editor of Spag magazine for players of Interactive 
Fiction. I got a reply, but, because of some attachments, which I don't know 
how exactly to remove because it would go over the size of messages for the 
list, I have forwarded the message to Thomas. Anyway, the point of this 
message is that Spag magazine would like an article about us as blind 
players playing interactive fiction, the next issue is coming out in a 
month's time. I am quite an amateur in IF, and still haven't tried out many 
interpreters and so on, so could someone who has more experience then I do 
with IF write the article about playing IF from a blind person's 
perspective, maybe saying what interpreters don't work well, how it's done, 
I don't know, just a general thing to make people more aware of us. There 
are some things I'd like whoever writes the article to highlight, though, 
like the, if we put in that we're still having problems getting these Pocket 
Interpreters to work on the Pac Mate, maybe someone would in the IF 
community would be prepared to modify them a bit, as the Source Code is 
freely available, and maybe other issues if there are still accessibility 
problems or just anything.

[Audyssey] one more thing

One other thing for the article which I forgot to mention, the problem that 
some text games need you to see graphics to solve them, an example would be 
the Quest game about you in a hotel trying to solve a murder. If noone with 
more experience has the time twrite the article, I'll be happy to try, but 
I'm worried it will not be accurate.

[Audyssey] the intro to the final fight in tj

I'm slightly disappointed with the way the intro to the torgan leader fight
is done.
I  hoped it would be something like this:
Ok, you have destroyed all my armies ! Hmm, nice try. Let me learn you a
lesson or 2 boy.
But instead the torgan leader is sleeping and tarzan awakes him by running
and shouting.
What a disloyal torgan leader! He is not even aware that his armies have
been killed, he lies asleep while tarzan is busy fighting the torgans! He
even didn't said anything to tarzan like:
Hay you have destroyed my armies but I will teach you a lesson personally
boy ha ha ha
He just moans because tarzan waked him up, that's all. So  it means that he
is not at all aware that his armies have been killed.
I wonder why Philip benfall decided on this intro rather than the usual boss
intro, ok you have destroyed myarmies, so I'll have to sort you out
personally.

But since when were the Torgons noted for their compassion? A race like that 
probably follows the most threatening one among them because they're all 
scared to death of him, and more likely than not he generally doesn't give a 
rat's arse about them. I actually liked the way it played out. It was kinda 
funny. Then you find out he's a wuss at heart after you pummel him enough.

I sort of got the impression that the leader was the brains of the 
outfit, - maybe the one who designs all the torgon's bombs and guns and 
such, rather than being the biggist and toughest Torgon, - which (as 
Bryan said), he obviously isn't.

[Audyssey] cops game and panzers in North Africa

Hi list, 
I was doing some reminiscing today and thought about those 2 games
mentioned in the subject line. I remember installing Panzers from the
floppy disc. smile 
I was introduced to the world of audio gaming via my Kurzweil 1000 disc. 
For those who don't know, Kurzweil 1000 has an extras folder on it with
many accessible programs and games. 
I remember the cops game, Monopoly, Maze, Mobious, and many other games I
tried during that time.
I bought the floppy version of Panzers in North Africa and Monopoly
somewhere around 1999-2000. The play was kind of slow and choppy, but I
really enjoyed those games. 
Thanks Jim Kitchen for making a more smoother version of Monopoly to
play. 
Is anyone working on a more recent version of Cops and Panzers in North
Africa? 
I really enjoyed the theme and play of those games, especially Panzers.
Having the various weapons and tanks was great. I know David Greenwood
did GMA Tank Commander, but It is not the same type of game.

Well, I can't answer for Philip, but perhaps the I am the big bad boss
speech is way over used in games. I've seen it in Tomb Raider, Star
Wars, etc and it is so common you can almost figure out what the boss is
going to say.

Well, I can't answer for Philip, but perhaps the I am the big bad boss 
speech is way over used in games. I've seen it in Tomb Raider, Star 
Wars, etc and it is so common you can almost figure out what the boss is 
going to say.

[Audyssey] BPC Programs

Do any of you know the status of BPC Programs and their game treasure hunt?

[Audyssey] online quizzes?

For example, on facebook, there are many brain tests where you have to solve 
puzzles and choose from options, you only have a little time to finish 
these. Does anyone know of more accessible games and puzzles that can be

give us an accessible game with sound effects for that Thomas, lol! 
Seriously, there's this really cool sighted board game, where, I can't 
remember what it was called, but what happened was the pieces were planes, 
and you threw dice and moved on a map, trying to answer questions about 
capitals and stuff, there would be cards you had to draw as well, with 
chance events like a terrible storm has diverted you to Helsinki. I can't 
remember exactly, but the aim of the game was I think at the beginning, you 
drew something that decided from where you started and to where you had to 
go, something like your flight must go from Washington to Melbourne.
I do actually wish there were some fun ways for learning geography, as it's 
hard to get braille maps here and I'd love to get a better idea where 
countries are compared to each other. I can of course say that Germany and 
France, for example, are in Europe, and I think I'm right that they even 
border each other, but I don't really know who's west of who, or where Ohio 
and Florida and all the states in the US are when you here people talk about 
them.

[Audyssey] fast gaming fingers and reflex?

Hi all,
This is quite a weird question or thought, I just would please like some 
feedback and funny stories if anyone has experience of this. I was trying to 
play running in an olympics computer game with my friend, now, how you run 
is you press the left and then the right arrow one after the other. What I 
want to know, is even from small, he has been able to press these arrows or 
at least, to use his fingers at incredible speeds compared to me. I am 
really much slower at games that need quick reflexes then he is. My question 
is, do you guys think that playing more would improve a person's fingerwork? 
I really find it amazing that people manage to finish games like Troopanum 
on absolute hard, I don't get anywhere near that, and, is it somehow a 
strategy, or extremely good reflex and listening? I also find it fascinating 
at how much the mind plays a part when you want to play. Sometimes, a person 
wants to play something fast-action, but, if you're not up to it mentally on 
that day, if you feel relaxed, even if you want to play well you just can't 
get yourself into the frame of mind to get the best hand-ear coordination 
possible, and, is it just me, but when you are with friends and want to show 
them how to do something in a game, nearly all the time that you're on your 
own, you can do it, but when your friends are there, at the back of your 
mind you know that you just have to get it right, you know that they're 
listening, hoping you'll show them how to do something, it's at moments like 
that that you just can't do it, like, I remember on my Nintendo, on the 
athletics, if you jump over the high jump bar three times in a row, you get 
a lovely little alien guy coming down in a jetpack, with cool sound effects, 
and giving you ten thousand points, but it was almost impossible to do it 
when you wanted to show your friends!

Hi,
Not only that, but it is sort of funny in a weird way. In games like 
Shades of Doom you have this long drawn out battle with the boss/bosses 
and then they all die. In games like Dark Destroyer there is a cool and 
satisfying

victory over your enemy.
TJ is different. The leader is like super wimpy, and you find out he is 
a coward.

[Audyssey] Important Montezuma's Return announcement

Hello gamers,
Earlier today I received an email from someone who worked for Utopia 
Technologies, the developers of a game called Montezuma's Return for the 
PC, and he was asking several pointed questions about conflicts of 
interest, copyrights, and that sort of thing. USA Games is currently 
discussing the matter with this individual, and we hope we won't have 
too many issues with this guy and Utopia Technologies regarding our own 
Montezuma's Return game. While there are some major differences we 
aren't sure if that will settle the matter or not.
However, if we should encounter any copyright issues with these people, 
find conflicts of interest, etc we will probably have to make changes in 
our own game to resolve those issues. I don't think there is any reason 
to begin pushing panic buttons yet, but I did want to inform all of you 
that USA Games is being asked some hard questions, and the guy we spoke 
to felt our game was far too similar to Utopia Technologies game. If 
that is the case we will make whatever changes is necessary to resolve 
any haggling with these people.

people like that, these big bullying corporate-types who try and find 
anything to sue over to just make money, that's the one thing I find not 
great about America, the culture over there of people just wanting to find 
problems and suing all the time. It's absolutely disgusting, I mean, how 
could anyone even confuse them with you, you are making a game for blind 
people, they're not even bothering to do that anyway.

It's not just Americans though. It's people the world over. Though I 
personally agree with trying to avoid opyright infringement where possible i

also know that it's nearly impossible for devs to make a game for the blind 
without stepping on at least one person's shoes. But there's still that 
strong part of me that feels it's their own fault anyways for not 
considering the blind gaming ommunity years ago.

It's got nothing to do with blind people. Stop using that as a point of
contention. They are drawing points to the fact that they are saying that
the game titles are similar. They won't care nore will a court about the
fact that thomas is making it accessible for blind people to play. I like
the accessible games and the like but you can't call a fowl play card if
someone in the end pulls you up on it. This goes right back to the point we
were talking about the other day ref piracy and copywrites. 

I do hope that thomas can complete his game though because I like what I
have read so far with regards to content.

people like that, these big bullying corporate-types who try and find

Thomas, There are sites saying this company doesn't even exist anymore, so 
how can they trademark the game like that? If they're not even existing, my 
guess is could this just be sour grapes and an excuse to try and get 
something by threatening? If they don't even exist anymore, how can they 
even have a case so petty, there's someone there with too much time on his 
hands.

It's not just Americans though. It's people the world over. Though I 
personally agree with trying to avoid opyright infringement where possible i 
also know that it's nearly impossible for devs to make a game for the blind 
without stepping on at least one person's shoes. But there's still that 
strong part of me that feels it's their own fault anyways for not 
considering the blind gaming ommunity years ago.
Time is an illusion, lunchtime doubly so.

 However, if we should encounter any copyright issues with these people,
 find conflicts of interest, etc we will probably have to make changes in
 our own game to resolve those issues. I don't think there is any reason
 to begin pushing panic buttons yet, but I did want to inform all of you
 that USA Games is being asked some hard questions, and the guy we spoke
 to felt our game was far too similar to Utopia Technologies game. If
 that is the case we will make whatever changes is necessary to resolve
 any haggling with these people.

Before this goes too far, did anyone notice that there's no need to panic? 
I figure that it can be reasonably worked out in, hopefully, a friendly way. 
If a game previously existed with the same name, and the game was basically 
like the USA Games product, and the developer of the older game is no longer 
selling the game, maybe something as simple as a disclaimer can be added in 
the instructions or license agreement or something.  Who knows.  For now, 
Thomas is merely letting us all know what's come up, and I appreciate it. 
Before we start cutting someone else down, or before we use blindness as a 
reason why he should be allowed to produce a game for blind people that 
someone else has had the chance to and did not, let's let the chips fall 
where they may, let them work things out, and then we can post whatever, as 
long as we do it reasonably?  Thanks.

Hi Ari,
For the record the person I was emailing today didn't say anything about 
suing me. At this point all he has done is ask me a lot of questions 
about conflicts of interests, how I obtained the copyrights to 
Montezuma's Return, how similar my game is to the Utopia title, etc. I 
am hoping this is just some confusion on his part.
I did explain that my game is an accessible game, made for blind and low 
vision users, and while it is similar to Montezuma's Revenge it is also 
different. I am hoping those diferences and the fact it is not a video 
game, per say, they will just leave me alone.
Though, after this little run in I am strongly thinking about changing 
the name of the game again. While I like the name I have for the game I 
would rather it not come up in search engines under Montezuma's Return 
which is a trade mark of another company.
As for suing it is a sad fact people are sue happy over here in the USA. 
When a woman can order hot coffee, spill it on herself, and then sue 
McDonald's for selling her hot coffee and win you know something is 
wrong with the legal system. I heard of a case involving a lawyer who 
payed for a pack of cigars, insured them for fire damage, smoked them, 
and then sued the insurance company for not paying him after his cigars 
were smoked and won. My point is that suing over here is often 
rediculous, but is a part of life.

Unfortunately, big corperations and even some smaller corperations don't 
see it exactly the same way. If it wasn't for laws like Section 508 
software accessibility would still be worse than it is today. Do to 
Section 508 a lot more companies are considering accessibility more than 
they use to, but Section 508 doesn't apply to some applications like 
games, software produced before Section 508, and there are probably a 
lot of other loop holes to use.
When it comes to game copyrights it is true it is very tough not to step 
on some companies toes because a lot of us just want to create a game we 
already know or wish we could play but can't. Unfortunately, it is a 
huge question of how the law would decide accessibility vs copyright 
infringement.

Hi,
I can assure you in one form or another the game will be completed. It 
is just a question of how the final product will be, and under what name 
it will be sold under.
Instead of bouncing and rolling skulls maybe I can use sword wielding 
skelitons. Perhaps I can add this or that to the game or game levels 
that will make it different from the way it was intended originally.

rediculous, but is a part of life.

Hi Darren,
Correct. The way the U.S. copyright system is set up copyrights will 
remain the property of a company or individual long after they are 
discontinued or dead. That is why it is so tricky for an accessible game 
developer to just come out with a game like Tomb Raider, Star Wars, etc 
and be legal.

Hi Ari,
Yes, it is true that Utopia Technologies no longer is in existance as a 
company. However, that doesn't matter according to U.S. copyright law. A 
copyright can be held by a company or individual for the life of that 
person or company plus an additional amount of years. Either way they 
still retain the trade marks and copyrights for their Montezuma's Return 
game, and will do so for a good many years yet. That is just how well 
protected trade marks and copyrights are in the U.S.A.
Strictly legally speaking, the company, or an officer of the former 
company, can request that USA Games change aspects of our game that 
conflicts with their copyright holdings. For example, I could be asked 
to change the name of the game, or change some element/elements  in the 
game that they feel is a conflict of interest.

Fortunately, justice was served in that case.  The cigar manufacturer 
charged the cigar smoker with a case of arson for each of the cigars, and 
won far more in damages than the cigar smoker had gotten, plus, he was 
arrested and, obviously, found guilty.  The problems with our court system 
are, in my opinion, that people will sue for just about anything, lawyers 
who should know better will take on these people as clients, and they win. 
If the judges would throw out these ridiculous law suits and charge the 
people who tie up the courts with them for all court costs plus damages, and 
charge the lawyers who are so money hungry for bringing the suits to court 
double what the clients are charged, and if word that this is happening gets 
out to the public as a message not to continue this practice, our court 
system could get on with what it is there for.  Seeing that justice is 
served in legitimate cases.

Could be. Under the circumstances changing the name might be advisable, 
but it is too early to say one way or another. I am definitly going to 
use a name change as a consession if it comes to that.. Something like 
Angela's Quest or something along those lines would be fine. It is still 
the name game just getting away from entangling trade marks or copyrights.

Yes, exactly. I said as much at the end of my original post. There is no 
reason to go pushing panic buttons yet. I merely want to inform or 
advise everyone that I have been officially contacted/notified, and I am 
dealing with an unexpected situation.
I also don't want to release Beta 10 with some unexpected changes. Wo 
dude where did that skeliton warrior come from, or why did you name it 
to Angela's Quest. I believe in letting my customers know what I know it 
when I know it, or at least inform them of possible changes ahead.

Hi,
True, but I don't really think there is much room for fighting. 
Montezuma's Return, the Utopia Technologies version, was released in 
1998, and that company is out of business. The game is no longer for 
sale, and perhaps that is reason for hope.
At the very least perhaps they will be satisfied if I change the name of 
the game, and make something miner like that. i am still awaiting for news.

I'm sorry to say,  But the game that Thomas is making can't really be a copy
right issue, as far, as if he using public domain sounds and the fact he is
not using any graphical parts of the original game.  I'm sure all the levels
are not even anywhere near the real game.

Heck the coding of the game is probley so far off from the original as well.

I really think the person that claiming copy right issue is stupid.

No, it's not missing, it's just in the xl studios folder not in the 
self-destruct folder, so windows can't find the short cut.

You can search with windows explorer, or use the Find files or folders 
command to search for the file keygen.exe.

Absolutely practice and atitude are everything.

Take today for example, when I first played the G force track on railracer, 
I was absolutely pants at it, even when I'd played it enough times to learn 
the obxtacles. Today I totally aced the track, and art ate my dust at the 
catch me if you can level, which was cool!

It's ages sinse I've played that particular track, but I was relaxed, and 
I've played Rr a fair bit more than when i first got to class four.

What is weerd though is that sometimes I just get into a great mental state 
and can waltz my way through a game without trying, and sometimes I have to 
work at it but can get through, and other times the harder I work, the more 
pathetically I do, it just depends upon the time and my concentration 
ability.

copyright laws were afterall created to protect good ideas and concepts, not 
to nit pick.

this game is plainly not on sale anymore (a quick google for Montizuma's 
return brought up nothing), so this fool is just making trouble for the sake 
of making trouble.

While he might have a case over the name montizuma's return, the actual game 
content I should think would be none of his business.

even in the mainstream, there have been cases of games which have been so 
similar in theme as to be incredibly suspect,  the original streets of 
rage and final fight for example, which had incredibly similar gameplay, 
virtually the same setting with similar levels, - streets, park, bar, 
finishing in a pent house, - Axle and Cody even dressed in the same 
geens and T shirt, both had blond hair and wrist bands,  and even had 
the same punch combo.

therefore if absolutely necessary make a name change, but I don't see why 
you would have to alter any game content just to panda to this petty minded 
individual. rolling skulls, snakes, spiders and all the other monti elements 
have afterall appeared in many other games,  Ghosts and goblins had 
rolling skulls for example, pitfall had snakes pits and ropes etc.

games with almost identical gameplay and game elements (even down to same 
main character and names), as original games, - I've come across several 
examples of boulderdash and loadrunner in this line, myself.

obviously you have much better and worth while things to do.

summers. rolling skulls, snakes and other enemies are so generic, that if 
they were copywrite, not many games at all would be able to use them even if 
the names were similar, - Eg, both the mainstream games Tetris and 
columns, which have amazingly similar gameplay and were on rival systems at 
the time have combo point bonuses, refer to their falling matchable objects 
as blocks, have a speed mode etc.

some games have even taken it further, streetfighter had a wandering 
martial artist called Ryu, Art of fighting had Ryo.

Heck! even names can be mucked about with, the game primal rage even had a 
character called sauron, - though pronounced soron, not in the 
traditional tolkeen way.

Another example. When you think about Mortal Kombat and Raiden. Some other 
game had that name in it but they spelt it differently and for a while 
copyright was a problem.

it's kind of random, and I don't want to send it to the list everytime as 
that's kind of spammy and ridiculous.
It's something I do randomly.  I randomly get bored and play games.
I'll think of something, but right now I'm half asleep and I don't have a 
good idea.  you could always join the mailing list at

which I've mentioned on list before.

well if you practiced enough and  got used to the sounds I suppose it would.
you may want to use a traditional keyboard not the laptop keyboard or a flat 
cheap laptop like board.
Mainly because you end up bashing the keys, and laptop boards are not as 
durable as normal boards.
I still have issues where reverse sterio is concerned, if someting is coming 
from the right, and then I need to push the oposite key to that I find it 
dificult probably because I don't play with it like that.

listening, hoping you'll show them how to do something, it's at moments like 
that that you just can't do it, like, I remember on my Nintendo, on the 
athletics, if you jump over the high jump bar three times in a row, you get 
a lovely little alien guy coming down in a jetpack, with cool sound effects, 
and giving you ten thousand points, but it was almost impossible to do it 
when you wanted to show your friends!

well here I learned in law lectures at tech that you can sue here but the most 
you can get is something like 40, I am not sure if its correct now, but you 
can sue all you want but you won't get it, there is a limit here you can sue 
for.

were smoked and won. My point is that suing over here is often 
rediculous, but is a part of life.
