[lace-chat] Ebay counterfeit Tiffany's
Hi Y'all - Here's a little summary of a new US court ruling on counterfeit Tiffany's merchandise sold on Ebay -- looks like we're not looking at the issue with the same jaundiced eye as France was last month. TIFFANY, INC. V. EBAY, INC. (U.S. Dist. Ct., S.D.N.Y., July 14, 2008) - A federal judge ruled that eBay is not liable for contributory trademark infringement for third-party auction sales of counterfeit Tiffany merchandise, and that the web company's use of Tiffany trademarks in its advertising, homepage, and internet advertising links is a protected fair use of the jewelry company's marks. [lace-chat] eBay lawsuit (France)
Hi All, Having seen many e-bay related discussions on this list, I thought people might be interested in this article that popped up in ForbesIt appears that a French court ruling held eBay liable for hosting sales of counterfeit goods, with possible broader implications for Europe and elsewhere to come. Regards, Ricki in Utah - hot and sunny weather here! * * * LONDON - Online auction house eBay is simply a host for transactions between buyers and sellers, not liable for any dodgy dealings that go on, right? Wrong. On June 4, a French court ruled against eBay (nasdaq: EBAY - news - people ) in a case brought against it by French ultra-chic luxury retailer Hermès over the sale of three Hermès bags, including two fakes, for a total of 3,000 euros ($4,715.50). I It's not so much the size of the fine that's likely to be keeping eBay executives awake at night: 20,000 euros ($31,439.30) is relatively small change for a company the market values at $38.5 billion. Rather, it's the precedent that the ruling by the court in Troyes sets, as it could apply to cases that might cost eBay a lot more and force it to rethink its entire selling strategy. In France, Christian Dior (other-otc: CHDRF.PK - news - people ) and LVMH Moët Hennessy Louis Vuitton have pending cases against eBay over counterfeit goods, worth 17 million euros ($26.7 million) and 20 million euros ($31.4 million), respectively, while in the U.S., Tiffany's (nyse: TIF - news - people ) case against the company completed its hearing stage last December. Hermès is the first successful case against eBay in France, and the second time an online intermediary has been found liable in relation to counterfeit charges, says Georgie Collins, an intellectual property lawyer at London-based business law firm LG. Last year LVMH was awarded $400,000 against Google (nasdaq: GOOG - news - people ) because ad words linked to sites selling counterfeit products. On June 4 the court said that by selling the bags on French site eBay.fr, the company had failed to act within its power to prevent the reprehensible use of the site, to the detriment of Hermès, according to Agence France-Presse. In response, eBay has said it takes counterfeiting very seriously and points to the steps it has taken since the case was first launched to improve its anti-counterfeiting measures. We are disappointed LVMH filed a lawsuit against eBay, the online auction giant said in a statement. We cannot discuss details related to pending litigation; however, we do hope that we can resolve this conflict with LVMH. Ebay has not yet indicated whether it plans to appeal. Losing such a case sets an uncomfortable precedent for online vendors. The verdict directly challenges eBay's argument that it is not directly responsible for what is on its Web site. EBay says that while it can take reasonable steps to ensure that it's not promoting counterfeits (by limiting the number of goods one person can sell and quickly removing goods after a complaint), there will be goods that slip through its net. Vetting each and every product before it goes up for sale online is not an option, the company contends. The judge has challenged the argument of Web sites such as eBay that they are merely intermediaries and that the sale of counterfeit goods has nothing to do with them, says Collins. The judge is essentially saying that they have to find a way of dealing with this. The sophistication of counterfeiters makes the potential liability of online vendors even more problematic. In some instances, the only way to tell a real good from a fake one is to return it to the producer and have it taken apart, says Collins. That means that the question of who should bear the responsibility of determining whether a good is fake has no clear answer, she adds. Currently, the courts in France, home to many of the world's top luxury brands, including LVMH and Hermès, have taken one of the toughest approaches to counterfeiting cases, Collins says. There is a real acknowledgment, carried through practically, of the importance of getting counterfeiting off the market. Europe is taking a tough look at the responsibilities of online vendors across the board. Last year in Germany, Rolex successfully sued eBay over a breach of its intellectual property rights, using the European Enforcement Directive of 2004, which harmonized intellectual property rights across Europe. The European Commission's e-commerce directive, which looks at the liability of intermediaries, is also under review. The International Anti Counterfeiting Coalition estimates that counterfeiting has skyrocketed over the past two decades into a $600 billion industry. [lace-chat] eBay UK listings not showing on .com searches anymore
I know that there are quite a few of you who use eBay and buy from eBayUK listers - myself included. However, are you aware that in their wisdom, eBay are now excluding eBayUK listings from general eBay.com searches? BUT eBay.com items are being shown on UK searches! I didn't know this until last weekend when I happened on a thread in the UK eBay Forums - and it's hitting UK listers hard, very hard. I'm OK as it's not my main source of income - it pays for our holidays :), but even I have noticed the lack of overseas interest in my listings. It's the fact that eBay didn't publicise this change that has got people's backs up most - even major sellers had no idea why their sales had dropped by over 60%+ in less than 3 months, as not everyone reads the eBay Boards [I don't as a rule]. SO, from now on, when you do an eBay.com search, please tick world wide down on the left-hand side if you want to see what's available from UK-based [and other non-U.S.] listers :) OR log onto eBay.co.uk and search there instead :) If anyone wants the relevant Forum links, please email me privately, as it's not just the eBay Forums that are running discussions about this. The original book appears to have 11 parts - tatting, crochet, knitting, neting embroidery, point lave, guipure d'art, Berlin work, monograms, initials and names, and pillow laces and lace stitches. I have a copy published by Chancellor Press in 1986, which has no copyright information as we normally expect to see it. In it's place is: Beeton's Book of Needlework was originally published in Great Britain in 1870 by Ward, Lock and Tyler. This facsimile edition published in Great Britain in 1986 by Chancellor Press 59 Grosvenor Street London W1 All rights reserved ISBN 1 85152 023 6 Printed in Czechoslovakia 50617 I read this as Ward, Lock and Tyler have the rights to their edition, so no copies can be made of it. Copies can be made of the original published in 1870. So it would depend on which edition the seller has copied as to whether it is illegal or not. The picture in the description looks like a modern cover to me, so I'd be wary. The later (properly bound) editions come up for sale quite cheaply and fairly frequently on ebay, and the original occasionally, but that sells for (what I consider to be) a high price. Yes, it's probably legal. The material is older than 1923. It is most likely no longer under copyright. The cost is very low. You can buy it from her, or you can search out a copy, scan it into your computer page by page for yourself. Your cost and time for doing this would be much more than the $4 price on the email copy. When a person gets this long email, it can be saved to CD if preferred. Since it's not shipped, there would be no shipping cost. This is just a modern version of the photocopied books and articles offered on eBay. Re: [lace-chat] eBay item mailing rules 7378547733
I just spent a length of time browsing through PayPal policies. All I can find is that the rules of the shipper must be followed. For USPS mailing rules, this is the reference: Seller Tools - PayPal Shipping - U.S. Postal Service Does U.S. Postal Service® offer insurance? Yes, indemnity coverage is available online through PayPal for up to $500.00 USD for lost, rifled, or damaged articles. Insurance available at post office locations provides coverage up to $5,000.00 USD. Insurance purchased online cannot be combined with additional insurance purchased at a post office. You can purchase USPS insurance online with: Express Mail® - Express Mail provides insurance up to $100.00 USD free of charge. Additional incremental insurance up to $500.00 USD costs $1.00 USD. First-Class Mail® parcels Priority Mail® Parcel Post® Global Express Mail - Global Express Mail provides insurance up to $100.00 USD free of charge. Additional incremental insurance may be purchased at a local post office. For Global Airmail Parcel Post®, you may purchase insurance at the post office. The amount of insurance coverage is contingent upon the destination country. For Global Priority Mail®, insurance is not available for purchase online or at the post office. --- Summary, as I see it -- Global Express has some insurance built it. Global Airmail regular depends on the receiving country. The lowest level, Global Priority, has no insurance. I think the policy stated on that eBay auction is really the seller's policy, not Paypal. Or it's the rule in one of the countries that he/she has shipped to. The rules for sales in UK and other countries may be entirely different. If someone wants to bid on this item, perhaps they should question the seller, first, for the source of the statement. Remember -- you can find 'anything' on eBay!!! i'm sure anyone of the office supply stores will carry colored typing paper and transparent colored clear vinyl, but i'll look at walmart, office max, and a few other stores that might have it. i'll do a search later and find out which stores have it. i found some of the vinyl coverings you use heat to seal onto the paper, but they were so expensive for just a few sheets it was cheaper to buy the clear contact paper. the best stuff to use is the clear packaging tape. it is a little tougher, and won't rip regardless of how many pins you put in it. i really don't like the clear contact paper at all, but i did buy a cheap brand. --- Anne Toney [EMAIL PROTECTED] wrote: Morning, Susan, A search of Yahoo doesn't show a CVS in Clarksville, but does list one in Oakridge. I had one last week supposedly from ebay which instead of the usual link to click on, had a submit button instead. With the link, if you put your mouse pointer over it, the actual address it links to is shown at the bottom left of at least Outlook Express rather than what the link says. The giveaway of you're not familiar with ebay addresses, is that the frudulent ones often have an @ symbol somewhere in them (but not always). Putting the mouse pointer on the button, gives no indication of where it leads to, and the only way to get any idea of the origin is to reveal all the details of the message. Mine came from an email adress with about 15 letters of the alphabet @hotmail.com. Forward any email you receive from ebay, Paypal or now half.com to spoof@ whichever they're supposed to come from. They'll tell you straight away if it's fraudulent, which 999 times out of a thousand it is. They need to have them forwarded so they can get the senders shut down and attempt to have legal action taken against them. I know they only start up again from a different address, but eventually they might be caught. And don't forget that if you delete a message from your in box, it might also need to be deleted from your deleted box to get rid of it altogether. re: [lace-chat] eBay sales
Hi everyone I thought I'd pipe up about bidding on something higher than retail - if one isn't inclined to bidding wars - and if the item is v. desirable, and if the postage to get it isn't prohibitive, and - particularly - if the item can be had from a seller living locally to the bidder - then it can be more cost-effective to bid highest, and above retail, if total costs are less than paying retail + extra shipping and handling. If you follow my drift ;) I have bid on and won the right to purchase several things based on this factor, have perhaps paid more than I could have otherwise, but I had the items in hand, and got to meet the seller, and didn't have to pay out for postage and packing. This is one reason why someone might be willing to bid higher than retail, though of course it wouldn't be everyone's reason. -- bye for now Bev in Sooke, BC (west coast of Canada) Cdn. floral bobbins http://www.victoria.tc.ca/~wt912 To unsubscribe send email to [EMAIL PROTECTED] containing the line: unsubscribe lace-chat [EMAIL PROTECTED] For help, write to [EMAIL PROTECTED]

As this has moved over to Chat, I'm breaking the rules and posting here as well as Lace where it originally was. First, I think it's just quiet because it's the weekend - it often is unless there's a rally strong thread going. Carol wrote: I was absolutely amazed that the Newnham (Newnham-style?) bobbin winder went for £1.00 more than it would have cost to buy new, and that was without the £2.00 x odd charged for postage and package. Is this a common phenomen, and does it usually happen that things end up more on eBay than they would be from a supplier This isn't at all unusual. People decide they want the item and don't bother to check what they can buy it for, and then auction fever takes over. I always check the price before bidding. Secondhand books can be checked through http://www.abebooks.co.uk or .com to see if the secondhand booksellers have the book and, is so, what their prices are. Lace equipment through the lace suppliers web sites. Item number 2379971290 which finished on the 19th went for eighteen pounds, which is the same price as SMP sell it for. If you click on the underlined 27 bids next to the word history, you'll see how the bidding went. The bidder spinningweaving was obviously hoping to get it cheaply, but pushed the price up with 19 bids, when he/she'd have been better off either putting the maximum he/she was prepared to pay straight away and let others push up to it or beyond it, or waiting till very close to the end of the auction (known as sniping, which is how I frequently bid, much to the annoyance of the person outbid, but it's legal) to do it. Bidding wars are a waste of time and energy. There's another Newnham winder Item number 2381593808, and spinning/weaving has put the opening bid on that. I'd guess the same amount as his/her opening bid on the previous one, which wasn't nearly enough. What he/she needed to do was to see what the person below the winner of the other one bid, because he/she'll probably be bidding the same amount (or higher) on this one as well. It's unlikely that the winner of the previous one will bid on this one, but not impossible. There's a group of twelve modern South Bucks bobbins for sale, and there's no point in bidding more than 12 pounds on those because Winslow bobbins make them for one pound each. Looking at the bid history for them daniellie is obviously keen on them because he/she put in the opening bid, was outbid, and has bid again. Bidding on ebay's fun provided you don't take it too seriously. If you don't win an item, another will come along some time. If someone's prepared to pay more than me, well good luck to them. Carol, if you're planning to sell your pillows on ebay, have a look to see what other have gone for to guauge what you're likely to get. Don't put them up for sale all at once because, if you've got 12 and 12 people want one, you'll get a low price for each. Put one up each month, and you'll more likely get several people bidding on each. Here it is: http://mjf.smsu.edu/faculty/wang/ih/career/1977_lacemaker.htm. Plot: Pomme, just passed 18-year-old, is an apprentice at a beauty salon in Paris. Discreet, graceful and quite, Pomme doesn't disturb anyone. She meets a dashing university student on summer holidays and falls rapturously love with him. The student is captivated by her gracefulness and attracted by her virginity. But his inability to appreciate her inner beauty leads to heartbreaking tragedy for the fragile young woman. Hi Jenny - I have seen copies of this film on eBay continuously over the years, so if you really want it, just be patient and you'll find a version you can use. However, as I recall from plot overviews I read long ago, this is a story of a hairdresser who is wooed by a rich young man. Can't remember whether it has a happy ending or not - haven't seen the film. But from all I could tell by the description, there didn't seem to be a lacemaker in the story!! (Unless there is some allegorical thing going on that wasn't evident in the blurb...) [lace-chat] eBay user group for Lace
hello spiders, been a couple months since i last read the digests, so i don't know if this has been mentioned. eBay recently started user groups on their site. i signed up one for lace, in the hopes that it would promote proper identification of lace items for sale on ebay, and also to provide an eBay-centric place for lace afficionados to gather. if you're interested in joining, to answer questions or to post your own, the location is http://groups.ebay.com/index.jspa?categoryID=1 look for Collectors Clubs at the top-left of the Group Center page, then Buttons, Textiles Vintage Sewingand the name of the group is Lace OnLine. it's free, all you have to do is be an eBay member. please be sure to look over the eBay User Groups policy http://pages.ebay.com/help/policies/everyone-groups.html Looking forward to seeing some of you there! kathryn __ Do you Yahoo!? [lace-chat] eBay sellers beware
This is only relevant to those of you who sell on eBay. There's a new scam email (been around for a week or so) purporting to be from eBay Customer Support, and I've just received one. The subject is: NOTICE eBay Obligatory Verifying - Invalid User Information The message starts: Dear Ebay user, We regret to inform you that your home phone number had an error on Ebay Inc. databases. We use your phone number for your identification purpose only. If the requested information is not provided to us then we will regret to inform you that your account will be suspended from our database until required information is provided. * Invalid User Information - Our records show that there are some discrepancies with the information that you registered with on our service. Due to this violation your account will be suspended indefinitely from the site until valid information can be provided.* There's a link to a web site on which they ask for your name address, telephone number, social security number, bank name, address, account number, mother's maiden name, credit card details including the security number on the back, and passwords - in fact everything except your bra size. Ebay and Paypal don't ever ask for this information after you've registered with them If something has changed, you do it yourself through the appropriate ebay or Paypal page, not in response to an email rom them. Exposing the headers shows that this particular email originates in Korea. I've sent mine to eBay. I've looked at the eBay chatboard, and the writers there seem to think that addresses of sellers are being obtained by asking the seller a question. Some say that they know this because they keep a separate address for answering questions, and this is the address the scam email has been sent to. The say they only reveal their main address to the winning bidder. On poor person said they'd fallen for it and sent all his/her details. The only thing they can do now is close their bank account and credit card accounts, and open new ones. The scammers will still have their address, phone number and social security number though. If you're an eBay seller and get a suspicious email send it to [EMAIL PROTECTED], with all the headers showing. Whatever you do, don't answer it and don't give them your details. There's also another scam/spam email which says the person's offering laptops at knockdown prices to people he's dealt with some time in the past before he puts them up for sale on ebay. This is another scam. Don't know the purpose of it, but it's not a genuine offer. Again from eBay chatboard, several people have had this email but from a different person and at various email addresses. I received one of these as well, and didn't realise it was a scam, but didn't respond as I've only recently bought a laptop. Could be just a method of establishing live email addresses. Well, now she's saying that they are knitting? tools because a kind lady told her they're not lacemaking tools. What I see is a (red) row counter (looking a bit like a cotton reel on the left-hand side of the picture), a punch for making holes in fabric for eyelet embroidery, a stitch holder for knitting and I think the thicker gadget with a metal pointy bit is probably for punched rug making. I agree - the things on the right are pins to hold hair rollers in place! Ruth Budge (Sydney, Australia) http://mobile.yahoo.com.au - Yahoo!
