Danforth. Friends and associates of former assistant U.S. Attorney Bill Johnston say he has been told by the special counsel's office that he will soon be indicted on charges ranging from obstruction of justice to making false statements to federal investigators. They say he has been told that the charges stem from his withholding of several pages of personal, pretrial notes from the 1994 federal prosecution of surviving Branch Davidians. They say that Mr. Johnston's action was a mistake driven by his concern that his notes would be misused by others in the U.S. attorney's office who were angry about his public criticism of the Justice Department's handling of the Waco tragedy. Mr. Johnston declined to comment Thursday, referring questions to his criminal defense attorney. The lawyer, Michael Kennedy of New York City, released a brief written statement Thursday confirming that the Waco special counsel has threatened Mr. Johnston with federal indictments in both Texas and St. Louis. "This law office and Mr. Johnston believe that he was unfairly targeted for his frequent criticism of the U.S. government and for blowing the whistle on the government's efforts to mislead the public about the government's use of pyrotechnic devices against the Branch Davidians," said Mr. Kennedy, whose past clients include New York socialite Ivana Trump and Whitewater target Susan McDougal. Officials with Mr. Danforth's office in St. Louis declined to comment Thursday. But Mr. Johnston's friends and former law enforcement associates in Waco say they already are rallying support for the embattled former prosecutor, starting a legal defense fund for what is expected to be an aggressive court battle. "We've got a group together. We're raising money. I'm spending most of my time today working on calling on some people with deep pockets," said David Smith, a former Waco city manager. "We're ready to fight 'em. I think that they're going to find that this community is 100 percent behind Bill." Several Waco officials said U.S. District Judge Walter S. Smith Jr. was so dismayed by reports of the special counsel's treatment of Mr. Johnston that he told Mr. Danforth's investigators last week that they could no longer carry firearms into the Waco federal courthouse and would be allowed only the access to the building given to the general public. Judge Smith, who has presided over all of the litigation arising from the 1993 Davidian standoff, has declined to comment. But other officials, who spoke on condition of anonymity, said two investigators for Mr. Danforth who had previously officed in the courthouse have not returned since the judge told them he had ended his court's cooperation with Mr. Danforth's inquiry and said he

Danforth: FBI acted properly at Waco ST. LOUIS, July 21 (UPI) -- Former Sen. John Danforth Friday cleared the federal government of wrongdoing in the 51-day siege at the Branch Davidian compound in Waco, Texas, and blamed the followers of cult leader David Koresh for starting the fire that killed about 80 people. Following a 10-month investigation, Danforth released his preliminary conclusions at a St. Louis news conference. Attorney General Janet Reno appointed the Missouri Republican to investigate the April 19, 1993, government assault on the Branch Davidian compound following years of charges that the FBI fired on the Davidians, igniting tear gas. The incident has become a rallying point for various militia groups and the alleged impetus for the bombing of the Oklahoma City federal building by Timothy McVeigh. "Government agents did not start the fire at Waco," Danforth said in releasing his preliminary findings. He also concluded there was no misuse of the military and no coverup. "There was no evidence of any wrongdoing on the part of Attorney General Reno, the present and former director of the FBI, other high officials of the United States," Danforth said. "The Davidians set their place on fire. They spread fuel. They set it on fire," he said. "The other thing that happened was that they began shooting their own, including children. Five children were shot to death in the head, execution. One child under the age of four was stabbed to death." In answer to a question, Danforth said his investigation placed the blame for the Waco tragedy "squarely" on the shoulders of Koresh and his followers, who refused to surrender. He said the Davidians resisted a legitimate arrest warrant with gunfire and refused for 51 days to surrender to the FBI, setting the stage for the tear- gas assault by federal agents. Deputy Assistant Attorney General Eric Holder issued a statement praising the report on behalf of the Justice Department. Holder directly supervises the FBI as part of his duties. "We are pleased that Senator Danforth has determined that the responsibility for the tragedy at Waco rests with the Branch Davidians, not the government. It is a finding entirely consistent with the decision rendered by a jury in Waco just last week," Holder said. "Today's independent review sheds further light on the truth, and discredits many of the unsubstantiated allegations that have skewed the public's perception of the events of April 19, 1993. The events at Waco led to the deaths of at least 80 Davidians and four ATF agents. We join Senator Danforth in wishing that this report begins the process of restoring the faith of the people in their government ." However, Danforth criticized the FBI for being less than open about the tragedy after it occurred and said that reluctance to disclose information fed public suspicion. "There is no doubt in my mind about the conclusions of this report," Danforth said in the preface to the document. "Government agents did not start or spread the tragic fire of April 19, 1993, did not direct gunfire at the Branch Davidians and did not unlawfully employ the armed forces of the United States." Danforth's report came after a federal jury in Waco issued an opinion that government agents were not responsible in a wrongful death civil suit brought by Davidian survivors and relatives. The special counsel was blunt in his assessment. " What is remarkable is the overwhelming evidence exonerating the government from the charges against it, and the lack of any real evidence to support the charges of bad acts," Danforth said. "This lack of evidence is particularly remarkable in light of the widespread and persistent public belief that the government engaged in bad acts at Waco. ...The readiness of so many of us to accept as true the dark theories about government actions at Waco deserves serious attention by all of us." All Americans carry the images of Waco, he said. "In the face of such calamity, we have a need to affix blame. Things like this just can't happen; they must be the government's fault," Danforth said in his report. "We are somehow able to ignore the contrary evidence -- never mind the fact that the FBI waited for 51 days without firing a shot, never mind the evidence that Davidians started the fire, never mind that FBI agents risked their own lives in their efforts to rescue the Davidians -- and we buy into the notion that the government would deliberately kill 80 people in a burning building." Danforth said the only "antidote to public distrust is government openness and candor. Instead, and tragically, just the opposite occurred after Waco." He said the government did "nothing evil" at the end of the siege, but "its failure to fully and openly disclose to the American public all that it did has fueled speculation that it actually committed bad acts on that day. Only the latter, he says, are his concern. Danforth's wish to limit the scope of an investigation is welcome, but the distinction seems all too facile. When bad judgment infects a government as powerful as ours, bad actions can be inevitable. Waco is one example, and the disaster unfolding in East Timor is another. A similar failure of judgment in action underlies them both. The government's mistake at Waco transcends, but is related to, the issues of whether ''military style'' flammable tear-gas canisters were fired at the Branch Davidian compound and whether that fact was covered up by the FBI. The profound act of bad judgment that led to those alleged bad actions was the prior decision to militarize government curtailment of the Koresh commune in the first place. Once a siege was set with the massing of fatigue-clad agents, on-scene advisers from an elite military commando unit, buzzing helicopters, armed vehicles, and a tank, what should have been a civilian law enforcement operation morphed into an instance of martial law. The initial purpose behind this show of ''overwhelming force,'' to use the phrase made famous by Colin Powell, may have been to intimidate David Koresh, but it was the mind-set of the federal agents that seems to have been most powerfully influenced by the staging of the siege. They stopped thinking like civilian law officers, whose purpose is to maintain order with a minimal use of force, and began thinking like soldiers who, once in combat, do whatever it takes to win. Once the martial drumbeat began, negotiators' efforts at persuasion had to seem untrustworthy to the besieged and all too soft to the besiegers. Soldiers know, perhaps better than police, that the law of critical mass applies to the mustering of arms: Once an overwhelming force is fully deployed, it carries its own momentum to be used, whether wisely or not. By the time Janet Reno was presented with the decision of whether to attack the Davidians, the pressures to do so were probably irresistible. As Colin Powell would be the first to say, don't set a siege unless you want a battle. A democratic society necessarily distinguishes between police and military functions precisely because in conditions of war, regard for civil liberties is an inevitable first casualty. Another is the principle of accountability to those outside the body of war makers. The Waco case, with the FBI behaving like an army at war both during the siege and in subsequent investigations, seems to have involved both abuses. When law enforcement becomes defined as war, as in the war on drugs; when police departments assemble arsenals appropriate to heavy combat; when traditional blue uniforms are commonly traded in for fatigues and jack-boots; when cops become commandos, an ultimate and prior bad judgment can lead increasingly to the bad action of government violence. The militarization of law enforcement, from federal to local levels, has infected this country like a virus. Waco is not the disease but a symptom. Even more disastrous has been the militarization of American foreign policy, and the most egregious example of this has long been Indonesia. During the Cold War, US policy makers turned a blind eye to the diabolical character of the Suharto regime and instead armed it to the teeth for strategic but also economic reasons. For more than a generation, the American arms industry made a fortune off Suharto. When his army seized East Timor in 1975, launching a war in which a third of its population died, we ignored it for the sake of our larger purposes - stopping Communism and fueling the arms race. But by the time we stopped Communism, the momentum of militarization continued, both in Jakarta, where, though Suharto fell, the army did not, and in Washington, where the Pentagon continued to favor the warlords. ''Pentagon reluctant to isolate Indonesia'' read a Globe headline a few days ago. Even this week, Defense Department officials opposed the military aid cutoff ordered by President Clinton, a belated but proper effort to influence events in East Timor. Now the ''bad actions'' of Indonesia's criminal military are on display for all to see, but they flow from a prior act of American bad judgment, the creation and on-going support of an Indonesian military whose overwhelming force has been directed only at domestic opposition or the illegally occupied East Timorese. The monster at large in East Timor this week was born in the United States. America must wake up to what it has become. We replaced our Cold War mortal enemy with ourselves. We are enthralled with the ethos of weaponry at every level in our culture. We define power through gunsights - children do it on city streets, but so do the occupants of paneled rooms in Washington. Danforth purchased between 100,000 and 200,000 dollars worth of stock in Bell Atlantic. This is the day after the Senate started their hearing on the anti-trust implications of the proposed Bell Atlantic/TCI merger. Two weeks earlier (October 15, 1993), the national media ran a number of stories about Congress' growing concerns over the proposed Bell Atlantic/TCI merger. The Washington Post quoted Sen. Metzenbaum as saying he was considering legislation that would block the Bell Atlantic/TCI deal. Metzenbaum said, "They're going to be in a position to drive out other companies in the market and that's bad for consumers." Sen. Danforth, on the other hand, was quoted as saying that telephone companies SHOULD be able to enter the cable television business. On June 14, 1993, Sen. Danforth purchased between 2,000 and 30,000 dollars worth of stock in Raytheon (i.e., Patriot Missiles). On the same day (June 14), the House introduced H.R. 2401: DEFENSE DEPARTMENT AUTHORIZATION ACT FOR FY94 (Became Public Law 103-160). During the period February 18, 1993 thru April 13, 1993, Sen. Danforth purchased between 160,000 and 450,000 dollars worth of stock in Tenneco. Tenneco own Newport News Shipbuilding and Dry Dock Co. which manufactures submarines and nuclear aircraft carriers, overhauls and repairs Naval vessels, refuels nuclear-powered ships, and provides navigation equipment for Naval vessels. During these months, defense contractors were "running-scared" over President Clinton's proposed defense budget cuts. In Congress, defense "hawks" like Danforth were busy with damage control. On the industry side, Tenneco and General Dynamics started a major marketing fight over who would get additional Seawolf Attack Submarine contracts. Between 38 to 44 percent of Sen. Danforth's Tenneco purchases were made from March 26 to April 13, 1993. It was during this period of time that Congress was debating and negotiating the EMERGENCY SUPPLEMENTAL APPROPRIATIONS ACT OF 1993 (Became Public Law 103-24 on April 23, 1993). This bill contained appropriations for the Department of Defense. During the period January 15, 1993 thru August 25, 1993, Sen. Danforth purchased between 37,000 and 205,000 dollars worth of stock in Texaco. During these months, particularly in the beginning of the year, Congress was wrestling with President Clinton's proposed BTU energy tax. Of course, firms like Texaco would be opposed to any such energy tax. On April 2, 1993, Sen. Danforth introduced S. 769: AVIATION FUEL TAX INCREASE PROHIBITION ACT (Referred to Senate Finance, Pending). Interestingly, but not surprising, Texaco manufactures AVIATION FUEL! Between 71 to 89 percent of Sen. Danforth's Texaco purchases were made AFTER he introduced S. 769. During the period January 15, 1993 thru February 2, 1993, Sen. Danforth purchased between 4,000 and 60,000 dollars worth of stock in Philip Morris. Sen. Danforth sold between 30,000 and 100,000 dollars worth of Philip Morris on April 2, 1993. On the same day, Frank Lautenberg (NJ) added himself as a cosponsor to S. 513: TOBACCO CONSUMPTION REDUCTION AND HEALTH IMPROVEMENT ACT (Referred Senate Finance, Pending). This bill sought to impose additional excise taxes on tobacco products. PAC NOTES: Sen. Danforth has received PAC contributions from Tenneco ($7,000); Philip Morris ($1,000); Bell Atlantic ($2,000). Notes: Sen. Danforth was # 4 on the Senate Finance Committee; # 3 on the Senate Intelligence Committee; # 2 on the Senate National Ocean Policy Study Subcommittee. On December 11, 1991, Sen. Danforth purchased between 100,000 and 250,000 dollars worth of stock in Sun Microsystems. According to the Atlanta Journal and Constitution, Sun Microsystems provides battlefield computer technology and semiconductors used in missile and radar systems. Bush also repeated his earlier denial of allegations raised in a Dallas lawsuit that a veteran Texas politician helped Bush win a pilot's slot in the Texas Air National Guard in 1968 as a way of avoiding active military duty in the Vietnam War. A former Texas state lottery director suing the state over his dismissal has alleged that Ben Barnes, who was speaker of the state house of representatives in 1968, helped Bush get into the air guard as a favor to his father, former President George Bush, who was a Houston congressman at the time. "I didn't ask him (Barnes) for any help. My dad didn't ask him for any help," the governor said in response to reporters' questions about the allegations. Bush has also denied claims that a Bush family friend interceded with Barnes on behalf of the family.
