I used dvb-kernel source in the previous version of RHEL ie 4.2
it worked fine in that. now with RHEL 4.4 its not running.

I finally found time to try your patch.
I used the second one that you posted called 500.disconnects since it clearly
superceded

Someone immediately suggested I should apply against the linuxtv.org hg tree.
Of course they had a valid point and I gave that a go.
I didn't have to muck around with symlinking the C header files like I did with
the kernel sources, and everything compiled first

I went and booted off my old kernel that did work, and it too is also locking
up after one second.
This was previously working fine for minutes/hours until the USB disconnect
occurred.
