It seems that for your particular use case, the .DS_Store file that gets written by the Finder is invalid and not parseable by it. It's broken. If it's possible, can you try your encrypted sparseimage on an El Capitan system and see if this bug has been fixed? If not, your only solution is to

FWIW, whenever Finder can't parse the .DS_Store file format, it defaults to opening in icon mode. I've seen this off and on, but especially with Yosemite. My guess is that the .DS_Store file format was never strictly defined (i.e., it's a hack), and it easily goes out-of-spec and can't be read,
