Schools consider appeals to NCAA By Steve Wieberg and Eddie Timanus, USA TODAY As Florida State moved Wednesday to protect its "Seminoles" name and symbols, at least two other Division I schools affected by new NCAA restrictions on the use of Native American imagery weighed appeals. Neither Utah, which derives its nickname from the local Ute tribe, nor Central Michigan, which calls its teams the Chippewas, has taken formal action. But officials foresee challenging an NCAA ruling that their Indian references and images are offensive. "We're still a little surprised at how this all came out and how the NCAA described what we do (in using the Ute as a symbol)," Utah athletics director Chris Hill said. "We know we have the support of the Ute Nation, and we anticipate that we will appeal." Said Central Michigan spokesman Steve Smith, "All indications are we will file an appeal." Other Division I schools — Alcorn State (Braves), Arkansas State (Indians), Bradley (Braves), Illinois (Fighting Illini) and Louisiana-Monroe (Indians) — have not decided on a course of action. Nor has Division II North Dakota (the Fighting Sioux), which plays Division I hockey and is scheduled to host an NCAA regional next March. The NCAA will prohibit any school not complying with its mascot guidelines from hosting any association-sponsored postseason events. Meanwhile, Rep. Tom Feeney,R-Fla., who sits on the House Judiciary Committee, said his office will push the NCAA to reconsider and, if rebuked, he'll seek legislative relief. That, the Orlando lawmaker said, could be an amendment to antitrust laws "to specifically prohibit what the NCAA has done. ... They have the right to promulgate reasonable rules, but they don't have the right to promulgate unreasonable rules. Effectively, they're restraining in this case the right of Florida State students and Florida State athletes and Florida State supporters to participate in and support postseason play." Feeney also criticized the new NCAA guidelines as restrictions on free speech and an infringement on colleges' autonomy. FSU athletics director Dave Hart Jr. was critical of what he called the "stealth nature" of the NCAA process. FSU and other schools, he charged, were kept in the dark. Though targeted schools were ordered by the NCAA to conduct and share self-reviews of nicknames and mascots, Hart said school and Seminole Tribe of Florida officials should have been invited to testify before the executive committee. NCAA President Myles Brand said he called Hart 24 hours before the vote "and told him that this is the issue on the table; I don't know which way the vote's going to go." Why not the Irish? The NCAA says it has never questioned Notre Dame's Fighting Irish nickname or leprechaun mascot because it hasn't received a formal complaint. "We have not gotten information from any group that represents Irish or (anyone of) Irish ancestry ... that they believe that image is hostile and/or abusive," said Charlotte Westerhaus, NCAA vice president for diversity and inclusion. "On the other hand, we had a lot of input from Native American tribes across the country that they believe the imagery at Florida State and other schools is (offensive)." Feeney raised the Irish question Wednesday. "There's no end to this," he said. "I happen to be an American of Irish descent. Should I be outraged at the notion that the Fighting Irish suggest a brawling, half-drunken Irishman? How about the Holy Cross Crusaders? Should every American Muslim be outraged at the thousands upon thousands of Muslims and atheists and non-Christians who perished during the Crusades? ... I really believe the NCAA is imposing the thought police on sports teams." Six Division II and III schools use "Fighting Scots": Edinboro (Pa.), Ohio Valley (W.Va.), Wooster (Ohio), Monmouth (Ill.), Gordon (Mass.) and Maryville (Tenn.). Two use Scots: Macalester (Minn.) and Alma (Mich.). PETA weighs in: The animal rights group People for the Ethical Treatment of Animals sent a letter to Brand on Wednesday asking the NCAA to stop South Carolina and Jacksonville (Ala.) State from using the nickname Gamecocks. The letter, a copy of which was given to USA TODAY by PETA, says Gamecocks "are named after the birds used in cockfighting, a hideous 'blood sport' that, like spousal abuse, bank robbery and driving while intoxicated, is illegal in both South Carolina and Alabama." Said Feeney: "For once, I believe that PETA, at least on the level of logic, is correct. I’m searching for a news story on this. I heard it on my local morning news, but haven’t found anything I can forward yet. But the story goes like this. U Georgia is playing Boise State in the opener. One of the kids from Boise has a father in Iraq. GA fans found out about it and paid for the man to come home to see his kid play, but the NCAA ruled that makes the GA fans Boise boosters and the gift is disallowed. So the guy can’t come home. This is just ridiculous. I heard an NCAA “fan” say on fox news yesterday that if member schools don’t agree with NCAA rulings they are free to pull out. Posted August 9, 2005 E-mail this article Printer friendly version Most e-mailed articles Florida State University is fighting the wrong fight in trying to keep its Seminole mascot that many American Indians find offensive. Ideally, the institution and its fans will recognize that before embarking on an expensive and embarrassing court battle. FSU's fans consider "Chief" Osceola leading the Seminoles onto the football field and sticking a flaming spear into the turf a treasured tradition. But American Indians have complained for years about the stereotypes portrayed at FSU and on other college campuses. Dozens of schools have listened to the concerns and changed their mascots out of respect to those who complained, while FSU and 17 other schools have not. The NCAA Executive Committee last week responded by banning schools that display "hostile or abusive" mascots from playing in championship tournaments, affecting all sports but football. FSU President T.K. Wetherell not surprisingly took issue with this, arguing that the Seminoles mascot is a tribute to the fighting spirit of the Florida Seminole. But Mr. Wetherell can't escape the fact that, intended or not, the images of Osceola in war paint and thousands of fans doing the "Seminole Chop" portray American Indians as savages. In his anger, Mr. Wetherell vowed to sue the NCAA. That would be a mistake, sending the message that FSU is willing to fight to the end for the right to offend people. It is a stand no respected institution of higher learning should take. An even bigger mistake would be to portray such a lawsuit as a battle against political correctness. The step taken by the NCAA is not an attempt to kowtow to interest groups. This is a recognition by the organization that these images -- historically accurate or not -- offend many of those whose cultures are being portrayed. Presumably Mr. Wetherell would not support calling FSU's teams the Pickaninnies and starting each game with students in blackface tap-dancing out to the 50-yard-line for a spirited rendition of "Camp Town Races." Times change. Just as black men resent being called "boy" and adult women wince at being referred to as "girls," American Indians object to terms like the Braves, Savages and Redmen. Why? Because demeaning terms justify and encourage subtle discrimination against individuals in the group. It perpetuates prejudice and keeps people in those groups on society's lower rung. FSU's defense that the Seminole Tribe of Florida has voted to endorse the use of the symbols by FSU really serves only to bolster the NCAA's argument. The leaders of the larger Seminole Tribe of Oklahoma -- where the United States relocated Seminoles they could find after fighting three wars -- cheered the NCAA decision. That only shows that FSU and others can't pick which Seminoles they want to listen to. The decision, which stunned Florida State officials, came out of Thursday's annual meeting of the NCAA's Executive Committee and Division I board of directors. The NCAA had asked 30 schools this spring to submit reports on whether their mascots, team names and pageantry violated the association's principles of cultural diversity. When the issue finally reached the Executive Committee on Thursday, few expected such a decisive policy after years of the NCAA's hands-off approach to mascots. NCAA President Myles Brand singled out 18 schools as having "prima facie hostile and abusive" symbols, and advocates praised that list for including what they consider the biggest offenders, such as Florida State, Illinois, Utah and North Dakota. The executive committee did not specify exactly what would be considered hostile and abusive. That definition may take years to evolve, with Florida State one of the first schools Friday to threaten a lawsuit. Executive Committee Chairman Walter Harrison, however, already has set the NCAA's sights on details as small as the spear on a Seminoles helmet. "An institution may adopt whatever mascots it wishes; that's an institutional matter that involves their integrity and autonomy as an institution," said Harrison, president of the University of Hartford, on a conference call. "But as a national association, we believe that mascots, nicknames or images deemed hostile or abusive in terms of race, ethnicity or national origin should not be visible at the championship events that we control." The NCAA does not control the college football bowl system, meaning the new policy may have limited effect on Division I football. But Harrison said he hoped the Bowl Championship Series would follow the same procedures. Big 12 Commissioner Kevin Weiberg, currently chair of the BCS, was not prepared to comment Friday. FSU President T.K. Wetherell said in a statement that he intends to pursue "all legal avenues" to overturn the decision, and he pointed to a resolution passed June 17 by the Seminole Tribe of Florida embracing the university's use of the Seminole name and imagery. "That the NCAA would now label our close bond with the Seminole people as culturally 'hostile and abusive' is both outrageous and insulting," Wetherell said. "The rules as we understand them would have us cover the Seminole name and symbol as if we were embarrassed, and any committee that would think that is a proper and respectful treatment of Native Americans should be ashamed." The new policy will take effect in February -- beginning, for example, with next year's NCAA basketball tournament -- to allow schools a chance to complain. But both Harrison and Brand stressed that the decision was four years in the making. Harrison was also confident it would stand up in court. While many advocacy groups were celebrating the decision Friday, the Seminole Tribe of Florida joined Florida State in its anger. "You have non-natives making a decision about native names," said Max Osceola, a member of the Seminole Tribe of Florida's tribal council. "Maybe it took them four years, but it's been a lifetime we've been known as the Seminoles." The NCAA took into consideration the resolution the Seminole Tribe of Florida passed June 17. But the Seminole Nation of Oklahoma has strongly opposed Florida State's use of the name, and that didn't escape the NCAA's attention either. "That is great news and wonderful to hear. Nicknames or mascots deemed "hostile or abusive" would not be allowed on team uniforms or other clothing beginning with any NCAA tournament after Feb. 1, said Harrison, the University of Hartford's president. "What each institution decides to do is really its own business" outside NCAA championship events, Harrison said. "What we are trying to say is that we find these mascots to be unacceptable for NCAA championship competition," he added. At least 18 schools have mascots the NCAA deem "hostile or abusive," including Florida State's Seminole and Illinois' Illini. The full list of schools was not immediately released. Not all schools with Indian-related nicknames are on that list. NCAA officials said some schools using the Warrior nickname do not use Indian symbols and would not be affected. Vernon Bellecourt, president of the National Coalition on Racism in Sports and Media, was pleased with the postseason ban but had hoped for even stronger action. "We would have hoped the NCAA would have provided the moral leadership on this issue, but obviously they've chosen to only go halfway," said Bellecourt, a member of the Anishinabe-Ojibwe Nation in Minnesota. The NCAA two years ago recommended that schools determine for themselves whether the Indian depictions were offensive. Florida State, for example, has received permission from the Seminole tribe in Florida to use the nickname. That, however, will not suffice. "Other Seminole tribes are not supportive," said Charlotte Westerhaus, the NCAA vice president for diversity and inclusion. At the University of North Dakota, where the Fighting Sioux nickname has come under fire, officials said they wanted to study the decision before commenting. "We just don't have enough information to know exactly what it means," said Phil Harmeson, a senior associate to school president Charles Kupchella. The NCAA plans to ban schools using Indian nicknames from hosting postseason events. Harrison said schools with such mascots that have already been selected as tournament sites would be asked to cover any offensive logos. Such logos also would be prohibited at postseason games on cheerleader and band uniforms starting in 2008. Among the schools to change nicknames in recent years over such concerns were St. John's (from Redmen to Red Storm) and Marquette (from Warriors to Golden Eagles). I left yahoogroups for the same reason you are complaining on this list. Half the messages are not delivered, and I was seeing delays of up to 48 hours. The private server works well when you have tech folks who know what they are doing. The guy at bluenorth hosting has kept the sandbox list running with no lag for 18 months. That’s why I’m following him to bluenorth and leaving the current host. What is happening with RTF is most of the webhosting companies do not know how to deal with a mailing list and when it actually starts being used they either a) throttle back on the speed causing the delays, b) throttle back on the number of messages they allow which further causes delays, or c) raise the bandwidth prices which causes a move. The techs fumbled sandbox badly, we had the list “breaking” for hours at a time until I found someone who knew what they were doing. That’s the guy I just referred mike to. And it cost through the nose. But, he’s broke from that company and set on his own and gave me such a great price I’m betting that he will give a great price for RTF too. I’m figuring if he can keep a group with the traffic of sandbox running with little problems he could keep RTF running that’s why I mentioned it. I’m evaluating googlegroups, but if you frequent the googlegroups owner tech lists you will find that they too are experiencing missing mail, delayed mail, and disappearing groups. *BUT* it is still in beta, so I’m hoping the finished product will be superior to yahoogroups. My "sandbox" list is *very* high traffic, about triple the traffic of this list with HTML and many pictures. During the busy times it's nothing to have several hundred megs of traffic inbound a day (not counting the resending that the list does to each member). I tell you this because the host for me is http://www.cmhe.net/ and they charge me $39 a month. It is a mailman based list. If you want to talk requirements with their lead tech contact [EMAIL PROTECTED] and address it to the attention of Bill. Tell him I told you. For the most part there are no problems, but sometimes messages are delayed, usually to a jam up on the server end. They usually respond within 30 minutes to a problem. As for HTML, knock your socks off until we see how it uses bandwidth. I've asked for this before with almost no response, but here goes: If you want a more reliable server then find it. A lot more shingles gone, several bare patches showing wood now on the roof. Water inside from the storm surge, all the carpets are wet, water inside from the bare patches on the roof, one ceiling came in on the SE corner of the house. My roofer tells me a minimum of 4 weeks to get to it, and Ivan is on his way. I'm on the list for disaster relief to come tarp my house, but I haven't seen them yet.
