Hi, While I agree with the intent of this proposal, I think it fails in a basic point.
Trying to define “abuse” may clearly depend on specific country jurisdiction. If APNIC act against a resource holder based on our own definitions, are we sure that those definitions, if the case is brought to courts, will work in Australia and/or the relevant country? This is the main reason we haven’t done this in any other RIR. Also the proposal, for example, doesn’t mention spam, scanning, intrusion attempts. For me those are the bigger offenders, as thru them you actually can do much more harm. If the legal assessment from the secretariat is ok with the proposal, at a minimum, we need to include also spam, scanning, intrusion attempts, etc. Some of those (scanning, intrusion attempts), may be done for research purposes, but in that case, there must be explicit text that requires previous and explicit consent. Also we need to make sure that it is clear in the text of the proposal that the bad behaviours are just examples, and other not-accepted conducts or activities, actual or future, are also considered abuse.
