I'm no lawyer (thank God!), but I don't see how that is significantly
different from "Your server software had a newer version available for free
with support for virus scanning but you chose not to use it, therefore you
are liable for the damage I inflicted on myself," or even "You chose not to
use a different server software with support for virus scanning, therefore
you are liable for the damage I inflicted on myself."
