He's probably confused with the DMA and TeleMarketers that have 
successfully gotten the FTC's Do Not Call list put on hold. The list was 
supposed to be active as of Oct 1st (with something like 5 million people 
already having signed up). But they successfully convinced a judge (two 
of them actually), that the list at least warrents further investigation 
as to if it is legal or not. So two different judges have agreed, and the 
date for which the list becomes active has been put on hold.
