On the other hand, the judge has not been good for the prosecution.  He has made several decisions that will be extremely good grounds for appeal, and the comment about muzzling her, while uproariously funny, is another incident the defense can (and will) use on appeal to show the judge had bias.
 
The best news for the prosecution is that they get a new judge when it goes to district court for trial.  If he's guilty, and I lean toward him being guilty, he stands a very good chance of getting the verdict reversed because of the actions of this judge.
