Porn is, in and of itself, legal. And it can be - and is -
advertised and sold by folks who don't spam, too. Porn does
not need spam to survive. I'm not sure whether the porn
industry is starting to discourage spamming - I'd have to
go visit some porn "webmaster program" sites and read AUP's.

Borderline illegal/fraudulent. As someone noted, Virginia went after
these guys. From a legal and regulatory standpoint, they're probably
the main target, since they're the ones who are defrauding people.

These guys don't worry me too much, since in the process, they usually
get enough of a school-of-hard-knocks education that they become
outspoken opponents of spam. Unfortunately, the education often
includes damage to their public image to a degree that'll take a long
time to overcome.

Harder targets than #2, I'd imagine - they're over the line legally
speaking, and have good reason to hide. Definitely targets for
lawyers, though.
