Having an unsubscribe, valid reply, and/or compaint address does not make an email
non-spam. Spam mail is any Unsolicited Commercial (or Bulk) Email. As for your proof
that the person signed up you having IP addresses means absolutely nothing unless you
can also prove that that IP belongs to the owner of the address. Theoretical
situation (well not actually theoretical as it happens all the time). Joe Blow (at ip
address 65.34.78.4) goes to your site and signs up to your list using Fred's (ip
address 243.172.78.4) email address [EMAIL PROTECTED] Ok so no you have AN ip
address for the person who did supply the email address to you. However the person
that supplied it is not the owner of the box. Thusly if you send email to that
address it IS unsolicited because the owner is not the one that requested that it be
added. The only way to ensure 100% that the address being entered belongs to the
person who entered it is by doing Opt-In Confirmations. When a request comes in to
be added to your list you need to send a simple email containing very basic
information (and NO commercial content) to that address requesting a reply to be added
to the list. The message itself should contain the name of the list, how the address
was requested to be added to the list (including the IP address if practical) and
preferably with a key that will uniquely identify the reply when it comes back in.
If you have not confirmed the addresses that are on your list through such a process
then you probably did actually spam (if any of the addresses on the list were forged)
and were reported correctly for doing such.
