I remember OMEMO's initial publication being delayed because there was no open standard for the underlying crypto. The Axolotl/Signal protocol at that time was merely an outdated Wiki page on Github. That's why the current version of the OMEMO XEP uses OLM. The fact how the main implementation is licensed didn't matter in the debate back then. At least from what I remember. And I think it shouldn't matter right now. - Florian
