OK, one last time smoking, drinking and sex are regulated activities.  The government 
regulates where you can smoke and drink, who is allowed to buy and sell smokes and 
drinks, and how many licenses are out there to sell smokes and drinks.  The government 
also regulates where you can have sex, or be naked, who you can have sex with (much to 
my liberal chagrin), what kind of sex you can have, and if you can buy/sell sex (the 
answer is no).  

Smoking, drinking and sex are not illegal.  They are all equally legal.  They are all 
regulated by the government!  The same government that says gays can't marry, or that 
you can't pay for sex, says that you have to be 21 to buy a drink or 18 to have a 
smoke.  It also says who can or can't sell the "legal" products.

So, back to my point that you attempted to dismiss.  Bottle clubs were problems 
because the got creative with the law.  Someone could become a "club member" by 
showing up at the door.  "Members" would pay for a set up (mix for the drink, ice, 
empty glass for beer).  "Members" who's bottle ran low, might have the staff "pick 
them up a bottle," for a fee.  The fee would be usually very high and it would take 5 
seconds to "pick up the bottle."  Gentle-man's clubs showed up as strip clubs became 
more regulated and would claim to not allow the "public" in only "members."  Of course 
all you had to do to be a member is pay money.  

Again, with that history.  Any responsible law maker would view that "private clubs" 
would be anything but private and would not give a license.
