The difference is that you have the option of writing a paper that 
conforms to the page limits and avoiding the mandatory fee.

If you were advised by the EIC that the 4 additional pages were required 
for publication, and that the paper could not be shortened, you should 
have asked for a variance on the fee for those pages or asked for 
specific suggestions on how to shorten your paper. If they were not 
responsive to either, you should contact the IEEE Conference Board for 
advice on how to proceed.

Submitting a paper that is *already* overlength from the start was not 
the journal's issue, though.
