I thought this particular topic had been put to bed months ago.
A bootleg is anything not produced by the record company or owner and sold
on to other people for financial gain. In this respect, 'First Step Beyond' is
not a bootleg, because, whatever the moral reasons behind Nijinsky's ownership
of the tracks, he was the legal owner.
Anyone who has purchased this CD will know that the vast majority of it is
unreleased tracks and demos, that are not copies of anything else previously (or
subsequently) available. This particular CD is not a CD-R, it is a properly
recorded copy, hence the original price-tag of around �17.50. Obviously, if put
up on eBay or its like for auction, it may well reach ludicrous amounts before
sold!
Others of you on the list will remember that the same individual/company
tried to put out a double CD called "The Lost" at the ridiculous price of �35.
This again contained more material from the same source as "First Step Beyond".
However, on this occasion, Mr Smash got to hear of it and (quite rightly)
threatened legal action as he wasn't being credited or therefore receiving
royalties for his copyrighted material.
I have to say, I wouldn't have paid the amount that the eBay copy went for.
Whatever people's views are about bootlegs is up to them, but ponder this: can
you honestly say you have never ever recorded copyrighted material for
other people or yourself without seeking permission? If so, you have broken
the law as much as any bootlegger. That even includes, doing a taped copy of
your Madness CDs to play in the car stereo.
If you own bootlegs and are all for their distribution then fine, but don't
expect others to agree with you. Similarly, if you're against bootlegs for
whatever reason, don't decry others who want the chance of hearing
forgotten/unreleased gems. Never the twain shall meet.

Insane!!! I'm a pretty avid collector of Madness stuff and have gone over the deep end with a lot of things (no sane person owns 8 copies of the same album only because each cover is a little different) but I draw the line at bootlegs. It seems to me, bootlegs aren't original by definition. It's an illicit copy, and usually the bootlegger is just running off CD-R's. Therefore whether the bootlegger copies it and I get a copy or Mike H copies it and I get a copy, it is still a copy. Now I realize that we all have diferent ways of looking at it, and if Yannick is happy with his purchase, wonderful. I can say at least he bought an already existing copy and didn't buy it from the profesional bootlegger. Cheers! - Elizabeth |
