The first thing you need to do is see if there is anything different about those files. Are they a different file type than your other files? Do they have embedded artwork and the others don't? Is there something strange in the tags? Also check things like sample rates, bit depths etc.
The Touch can natively handle a larger number of file formats, so the server might be transcoding some files to the SB3 and not to the Touch, and if the Touch is having problems with that specific format it might cause what you see.
