Specifying the requirement for situational constructs must be determined by the covered entity evaluating the situation defined for each construct, and then determining whether it applies to them or not. In some cases, the truthness/falseness of a given situation can be determined only by the provider or submitter of the transaction and in other cases, it's the payer that has the prior knowledge to make this determination.
