A companion document may indeed require those situational elements, but only when the 
situation occurs.  The situational criteria is defined within each implementation 
guide.  As far as requiring a NOT USED field, a NOT USED field is just that, it MAY 
NOT BE USED under any circumstances.  In the implementation guides there are two 
separate but distinct definitions of segments and fields.  First there is the X.12 
Standard which defines all fields, second there is the "Implementation of the full 
X.12 Standard".  HIPAA only allows the "Implementation" set to be used to be compliant.

Each segment in a IG is displayed 4 ways.
1. IMPLEMENTATION
2. STANDARD
3. DIAGRAM 
4. ELEMENT SUMMARY

Mandatory in the STANDARD means Required in the IMPLEMENTATION.
Optional in the STANDARD means Situational in the IMPLEMENTATION.
In the Diagram portion:
Boxes outlined in bold indicate REQUIRED elements.
Required: You MUST use this element
Other elements are situational.
Situational: Read the BOLD print to determine in which situation the segment, element, 
or code becomes required or not used.
Elements crossed out indicate NOT USED elements.
Not Used: Do NOT use this element

Probably ignorant questions, but I must clarify for my own sanity:

In a companion document, is it HIPAA compliant for a covered entity to
"require" certain "situational" loops/segments/data elements of its trading
partner(s)?  What about when the covered entity wants to "require" certain
specific data in "NOT USED" description fields?
