The law has a few technicalities involved. In Leviticus and Deutoronmy we see so much of this...but generally these laws stem from one major commandment..."Love your neighbour as you love yourself". There are restrictions on the level of security that one can use...e.g. you cant shoot at a thief without firing warning shots.
The argument is to protect society from exercive use of force which can lead to a lot of trouble and chaos in society. Basically this household owner will be charged with a number of crimes which include breaking household laws, electricity supply laws, alarms and fences laws etc. You know just because you own a house don mean you can do what you want. If you gonna build, it's gotta be inline with certain min materials standards depending on where you are. And ya aint allowed to put certain fences without the consent of your neighbour like a 3 meter durawall....or even build a double story house..there are Local Authorities By Laws which restrict such activities. There's a great deal of technical jargon that just so makes life a little more complicated and gives employment to lawyers. So yep this guy has a big case to anwer..maybe Capable Homicide!! You cant shoot a guy for stealing mangoes from a tree on the durawall...it's absurd! Of course unless you have been violently threatened and your life is at risk. Have a great day.
