Malt beverages can be sold at more places than spirits based beverages can. States get to make their own laws concerning the sale of alcohol and I live in a state, Pennsylvania, which has had some of the most draconian laws and is slowly opening up. For example, it was only through a reform bill passed last year that spirit based cocktails can now be sold at stadiums. And if you look at a barleywine brewed in the US you will see on the label that it is a barleywine style ale because there are different laws governing the sale of ales and wines.
