Intel dropped support for PXE approx. 2 years ago.  I'm not sure what the licensing 
terms are but it's very unlike that the folks @ Intel would care one way or the other 
about the use of this driver.  They were making any money on it in the first place.  
Since you are not selling a commercial product, I wouldn't lose any sleep over it.
