Go to <http://www.macosxhints.com> type in 'empy trash' (without the 
quotes) into the search box at the top. It will list a few solutions. 
These have always helped me when I manage to get a stubborn file. Or if 
you aren't afraid of the Terminal:

cd ~/.Trash
sudo rm -rd *

That will get rid of almost everything.
