I think there is a distinction. When you release software, you can do so using an open-source compliant license. As long as you follow the guidelines of the license, you have then released "open-source software." Now, just releasing it with an open-source license may not be considered in the "spirit of open-source" which usually involves such things as open-ness, community, sharing, inter-operability, mailing lists, wikis, etc...
