The patent wasn't issued until August 25, 2015. Maybe you mean an earlier patent? Anyway, if the replication does not follow the patent exactly it has no bearing on it. Even if the experiment works it cannot be used as evidence in support of the patent. That is my understanding, based on discussions with David French.
