His response:
BY LAW, YOU CANNOT PATENT A THING THAT OTHERS HAVE ALREADY DONE, EVEN IF 
THEY HAVE NOT PATENTED IT.

I think he is wrong about that. If someone here knows a lot about patent 
law, please advise.
