I run a web site for alumni of a small, no-longer-in-business
company (SofTech).  I have about 240 email addresses, some
sent in by the actual addressee and some by their friends.
Suppose I send email to everybody announcing some new content;
isn't that spam by this definition?  It's "unsolicited,"
certainly by those who didn't send me their address and more
arguably by everybody.  It's "other content" (as is everything,
of course).  It's a "mass mailing," assuming that "mass" has
any reasonable definition.

You say that the ISP management will decide that this isn't
really spam?  What if we were a political organization rather
than alumni, say "Liberal Democrats for Bradley," the ISP
is run by right-wingers, and they declare that my mailing
is spam and throw us off?

Maybe my mailing _is_ spam.  Some of the people receiving it
could well dislike the company/candidate and be displeased
by the mailing, and could complain to the ISP.

Instead of a shrinkwrap-license-like clause in the ISP
agreement, how about if ISPs implemented a hard limit on
the number of outgoing email messages that a single account
can send, say 100 per week?  Customers with legitimate, non-
spam need for a higher limit could apply for it by submitting
an explanation of their need.
