Well, that's a good point @Denny. I can point to a message on the Wikidata WMfr mailing list where @Karima clearly explain how some contributor envision that point and promote a *adventurous beyond legal attitude* regarding license issue. The terms of use of the list don't allow to share it (plus it's in French, obviously :P). But maybe @Karima will be OK to express again this point of view in the current ticket.
Basically my understanding of this statements is that for this like-minded contributors the plan is to consciously cross the red line and bet on a the establishment of a jurisprudence that will comfort their opinion.
Apart from that it would be interesting to improve https://tools.wmflabs.org/wikidata-todo/stats.php to be able to evaluate how many statement are sourced from which data bank which release them under which condition.
As it is, there are 50M statements which comes from Wikipedia, which is under CC-by-sa-unported 3.0, which is not compatible with CC-0. If the same statements might be linked to PD or CC-0 sources, et would be fine, but in current state, their presenc in Wikidata raise license concerns. This concern might possibly be resolved through something like the jurisprudence that @Karima and its like-minded follow have in mind, by removing them from Wikidata, or by some other solution yet to identify.
A similar concern apply to the 100M unreferenced statements, although here it's not clearly in conflicting with any term of use, it is just in completely unknown legal situation.
For the rest of statements that have sources, it would be nice to have a more precise report which indicate how many statements come from regrouped data banks, with their corresponding licences.
