While this is all true, I think a 3 year prison sentence is a bit over the top (ok, a lot over the top). At lot of other more serious crimes get a shorter sentence - first time DUI often gets 30 days or less and they have the potential to kill.
Time will tell if any judge dishes out (or an appeals court upholds) a 3 year prison sentence for copyright infringement.
On RealTV just a couple of days ago they showed an armed robbery that took place at a convenience store here in Ashland, Ohio. As most crooks are idiots this guy walked up to the counter, the guy at the counter backed away as he was just talking with the clerk & the idiot pulled out a butcher knife & demanded that the clerk lock the doors & give him all the cash but the guy that backed off was a plain clothes cop. The reason I'm writing this is the idiot got a 3 to 10 yr sentence for his attempted armed robbery but was released after only 2 mo & placed on shock probation. While this sentence reduction may or may not have been justified there are many more people getting harsher sentences smoking wacky tobaky.
Just as an observation but the law seems to be targeting only P2P networks but seems to imply even if one were to download from another country that possession is enough to convict one of the crime. All this means that the MPAA & RIAA still has to track these items & once one crosses into a personal computer doesn't that violates one so called right to privacy [ I know another can of worms ] ?
This really is not the place to discuss legalities or sentencing for crimes whether one agrees with them or not.
