This noise floor is only a limiting factor if you use a transmission method with no coding gain (certainly not the case with these 802.11 systems). GPS is a prime example of a system that must operate below the nominal noise floor.
Note also that unlicensed is very different from unregulated. One can only the unlicensed bands with Part 15 certified equipment unless the products fall under the 15.23 home-built devices exclusion. Any prototype devices require experimental licenses.
