So contracts, which tell us "you can distribute under ODbL only" wouldn't be valid for DbCl, which is part of OpenStreetMap's use of ODbL (facts are free etc.). [OSM-legal-talk] Vector Tiles: ODbL and non-free data
Hi there. Mapbox allows it to upload own data under a properitary license and deliver vector tiles and raster tiles. Let's say, I want to overlay OpenStreetMap data with my own, non-free data. Just overlay, no other interaction. Does ODbL allow it, it combine both datasets in one vector data stream or do I need to request the tiles in seperate layers. Actually, these vector formats are modified SQLite databases, which might allow it to seperate OSM from foreign data, the problem is the rendering. The data gets rendered in the client's browser. OSM data gets mixed with the foreign data and rendered to one temporary image (which only gets cached). Do I need to render each vector layer on its own or is OdbL open that much to allow my intent? Dear list, could you please recommend me licenses for releasing data to ODbL? From my point of view, compatible licenses are CC-license without "SA" and "BY" and (only if possible) CC0 and PD or finally special license, like the following one: Some crporations like "Deutsche Bahn" (the biggest rail corporation in Germany) has released their data under CC BY 4.0 with a special text for OpenStreetMap (roughly translated): "If the data of Deutsche Bahn is part of the OpenStreetMap database work, a reference to the Deutsche Bahn AG in the list of contributors is enough. Crediting DB at each use of the data by a licensee of the mentioned database work is no longer necessary then. Indirect credits (with reference to the publisher of this databse work, which refers to the DB) is sufficient." Actually, that's a kind of dual-licensing with a special license for OSM. From my understanding, releasing data ODbL would be the worst thing, since the "BY" attribution of the data donator isn't compatible, is it? Hi there, according the the Community Guidelines for Horizontal Map Layers, feature overlays have to be released unter ODbL, if they're completing content on an online map. Quote from http://wiki.osmfoundation.org/wiki/License/Community_Guidelines/Horizontal_Map_Layers_-_Guideline "For example, if there are restaurants in the OpenStreetMap layer and you add additional restaurants in another layer, but you include only those restaurants not present in the OpenStreetMap layer so that the restaurant layers will complement each other, then the layers for this feature are interacting and the restaurants added in your non-OpenStreetMap layer must be shared." This would mean: If I show parking facilities for bikes as an GPX or GeoJSON overlay as a layer an top of the OpenStreetMap base tiles, which might already included existing facilities, I'd need to publish my overlay under ODbL? This guideline takes clause 4.5(b) as a background. This clause is for produced works only... Does this clause even work for overlays? Also the examples shown below on the page aren't pretty clear either: "If you improve data used in the OpenStreetMap layer, such as additions or factual corrections, then you need to share those improvements." => So this example is for the OpenStreetMap layer only. I won't touch it. "You add restaurants in one area from non-OpenStreetMap data based on comparison with OpenStreetMap data in other layers." => What if I don't run a comparism before? Perhaps it's fortune. "You add a non-OpenStreetMap cemetery layer that is defined as 'all cemeteries not found in the OpenStreetMap data layers'." => What if I don't explicite tell that those data is missing? Hi there, I don't know, if this thematic has already been discussed on this list, but European Court of Justice (ECJ) has confirmed the classification as a database for (printed) topographic maps (see EuZW 2015, 955). Yet the commentaries can't foresee the consequences, but publishers are happy to see a stronger proction of their maps and data. So here's the new problem: Printed maps are equal to databases in terms of 96/9/EG. And that's exactly the same directive, ODbL is about. What were ODbL's definition of data classifications up to now? 1. a derived database, like osm2pgsql database imports, 2. a collective database, with different licences seperated in tables, 3. a produced work, like a printed map / a printed T-Shirt / a tattoo. According to the latest decision of ECJ, a printed map actually is a database in term of the database directory and of the ODbL. There needs to be a revision of the ODbL to cleary state, what's a printed map. From the legal site, it's not a "produced work" by the old meaning anymore. That's something, the employer didn't take into account and it might break the use he had in idea. We are about using OpenStreetMap data on an area of about 5000 square kilometer. [OSM-legal-talk] share-alike on generalized data?
Desr members of Legal-Talk! I'm working on a project, which mixes feature classes of different sources: buildings, landuse and other data from a local mapping agency and streets streets from OpenStreetMap Since the produced work will be published, share-alike needs to be discussed. At lower scales, the resulting map should be generalized. While the licenses of the mapping agency don't have a share-alike licens, ODbL does of course. At some places, OpenStreetMap objects might get moved or pushed to prevent cartographic collisions with the other objects. Also, landuse areas could be snapped to OSM streets to fill the wholes. Since this process includes an (automatic processed) interaction between foreign and OpenStreetMap data, share-alike might step in. Since the process of generalization doesn't make the quality of OpenStreetMap data any better (f.e. higher position error), the results won't be useful at all or could even have a bad effect, if they get imported back into OpenStreetMap. According to ODbL, I'd need to publish the changed streets, a changeset (or equal) or a description, how to change the data - but only upon a request. Is this useful for generalized data at all? Hi there, I've got a question concerning credits to give when using OpenStreetMap tiles or data. A qoute from English Legal FAQ [1]: 1. (c) OpenStreetMap (and) contributors, CC-BY-SA (tiles) 2. Map data (c) OpenStreetMap (and) contributors, CC-BY-SA (data) The German FAQ translates the first point into (c) 'OpenStreetMap' (und) Mitwirkende. The meaning of Mitwirkende is active participants (direct translation *is* contributors). And now, I've got a problem: According to this website [3], contributors are equated to donators of data and not as members of OpenStreetMap. Now, why are there two groups? 1. OpenStreetMap (the people / the community) *and* 2. contributors Okay, the and is in brackets only, but who added it and why? I think, traditional credits were OpenStreetMap contributors. That's much better, since it applies to the whole community, but [3] gives a complete different meaning... From my point of view, these credits would be okay: 1. [Map data] (C) OpenStreetMap community, CC-BY-SA 2.0 2. [Map data] (C) OpenStreetMap contributors, CC-BY-SA 2.0 3. Hallo Leser der Mailingliste, ja ... mal wieder eine Nachricht von mir ;-) Die Community Dortmund hat mal wieder etwas ganz Tolles für Euch: neue, hochauflösende Luftbilder! Hintergrund: Ralf Christmann ist OSM-Mitglied und Mitarbeiter der Stadtwerke Witten GmbH. Er hat sich dafür eingesetzt, dass uns ebendiese hochauflösende Orthofotos der Stadt Witten (Ennepe-Ruhr-Kreis) und Umland bis auf Weiteres zur Verfügung stellen. Es handelt sich um eine Gesamtfläche von 136 km² bei einer Auflösung von 10 cm! Neben der Stadt Witten werden Teile der Kommunen Bochum, Dortmund, Sprockhövel, Wetter und Herdecke tangiert. Seit gestern, dem 23.08.2010, sind diese Bilder auf dem OSM WMS-Server online und können von jedem OSM-Mitglied, wie üblich, in JOSM Co. eingeladen und abdigitalisiert werden! Mehr Details bzw. [Talk-de] Ich bin dann mal weg.
Hallo Community, aufgrund der aktuellen Entwicklungen und zunehmenden Stasi-Methoden bei OpenStreetMap habe ich mich dazu entschieden, (mich nach dieser Nachricht) aus dem Talk-DE zu entfernen. Ich habe echt keinen Bock mehr auf die Kontrolle und Einschränkung verschiedene Aktivitäten sowie auf die ständige (Selbst-) Einschaltung der OSM-Polizei (wer es nicht weiß: Frederik Ramm, Sven Anders etc.). Schon auf der FOSSGIS in diesem Jahr hatte ich die Schnautze voll, aks ich Jochen Topf ziemlich abwertend über einige User habe reden hören (wir standen beim Essen in der Eingangshalle und er sprach am Nebentisch mit ein paar Mitarbeitern von Kommunen). Ist schon schlimm, was man alles als Erfolgsautor erdulden muss - Hände schütteln, ach Gottchen. Ich habe eine Menge RAM, der von Windows nicht als Arbeitsspeicher adressierbar ist. Kann Linux bei 32-bit mehr als 4 GB adressieren? Viele Sachen laufen bei mir nicht unter einem 64-bit Linux. Bringt es was, die zu erzeugende Datei in ein RAMdrive zu packen? Oder lieber die zu lesende Datei? Mit der H2-Datenbank als Alternative ist das Lesen kaum langsamer aber der Import massiv schneller. Was heißt langsamer bzw. massiv schneller. Hast Du Prozent? Ich konnte mir die POIs endlich in Aktion ansehen. OMG ... die sind teilweise um 180° verdreht und teilweise komplett veraltet, ich schätze den Stand auf 2006. Das mit den POIs hätte sich Google wirklich verkneifen sollen. Es bleibt eine spannende Frage, ob man letztere auf Dauer motivieren kann, denn nur dann bleibt OSM so tagesaktuell wie es heute ist. Die Performance der Dynamik geht aber - selbst bei Croudsourcing - runter. Also Muenchen wird zwar oft das Millionendorf genannt, gilt aber allgemein auch als groessere Stadt ;) Da kenne ich mich aber nicht aus, kann also keine Fehler entdecken. Die entdecke ich erst vor Ort ;-) Hab jetzt noch ein wenig rumprobiert. Beim Klick auf den POI bekomme ich schon mal die Adresse mit Hausnummer und kann die letzten Meter klassisch zuordnen. Im Moment ist das was ich auf Google Maps sehe fuer mich ein klarer Mehrwert und ich habe in Muenchen nach wie vor noch keinen ueblen Fehler gefunden. Diesen klaren Mehrwert bekommen wir in OSM auch hin, wenn wir endlich mal anfangen würden, Hausnummern vermehrt auch nur grob einzutragen. Keine Ahnung, aber wenn man alle 50 Meter stehen bleibt, um eine Hausnummer aufzunehmen, kann man wohl auch Informatikerinnen zur Verzweiflung bringen. Oder bekomme ich eine Liste aller Postunternehmen dieser Welt? Wie soll hier eine entsprechende Auswahl erfolgen? Ersteres weiß ich nicht, aber eine Vorlage Post-DE wür e zunächst ja reichen?
