Essentially powerless, as a last resort such a person can always threaten to Tell All. It is not a strategy with a future. That's what struck me, reading Serbian Prime Minister Zoran Djindjic's remarkable interview in last Sunday's issue of 'Der Spiegel,' the German magazine. In the interview, Djindjic confirmed that he and Yugoslav President Vojislav Kostunica are liars. He confirmed that they are flunkies for the U.S. He confirmed that everything the SPS said in its statement, We Accuse: Washington's Aid Promises Are A Traitorous Lie! about the 'Donors' Conference and everything they said about Washington's disloyalty to its flunkies was true. He confirmed the accusation that we at Emperor's Clothes have made, that Washington wants Yugoslavia scaled down to zero. Why would Djindjic give such a politically explosive interview? In the brief summary preceding the interview, 'Der Spiegel' writes that Djindjic feels the West is not being helpful enough, is not coming across with sufficient aid, and so on and so forth. None of which provides a motive for the extreme content of the interview. But at the end of this pre-interview summary, 'Der Spiegel' cuts to the quick with the following short comment from Mr. Djindjic: I warn the west. I WARN THE WEST! By confirming the truth of charges that have been made by the Socialists and other critics, Zoran Djindjic is sending the following message to Washington: Zoran Djindjic is highly displeased with the way Washington is handling that most important of questions, the well-being of Zoran Djindjic; and he is not about to be a fall- guy for NATO. Why is Djindjic worried? He and his sometime partner, Vojislav Kostunica, obeyed U.S. dictates and tried to push through the Federal Parliament an unconstitutional law to extradite Slobodan Milosevic to the Hague 'Tribunal.' When the attempt to pass this illegal legislation failed, Djindjic obeyed U.S. dictates and played the open role in kidnapping Mr. Milosevic. The kidnapping was followed by massive protests. As we have shown in 'THE TREASON OF VOJISLAV KOSTUNICA,' it is absurd to argue that Djindjic is guilty in the kidnapping but that Kostunica is innocent - yet, since the kidnapping, that is precisely what Kostunica has argued. KOSTUNICA'S APOLOGY Hunching over a long table, Yugoslav President Vojislav Kostunica squinted into the television lights, turned to his people and confessed that higher powers had gotten the best of him. Kostunica said that others in the government had ''overruled'' his opposition to Slobodan Milosevic's extradition to the U.N. war crimes tribunal a week ago. Then, as if that wasn't humiliating enough, he was kept in the dark about the handover itself. Like millions of ordinary Serbs, he heard about it from the media. ('AP Online' July 6, 2001) Right. Tell us another. This 'self criticism' is an attempt to pin the blame on Djindjic. And it isn't only Kostunica who is trying to protect Kostunica at Djindjic's expense. Indicating which way the wind is blowing, virtually the entire Western media plus some critics and would-be critics of NATO have chimed in, accepting President Kostunica at his word, as if a politician's protestations of patriotism and innocence after the fact were proof that he actually opposed an attack on Mr. Milosevic, the key defender of Yugoslav sovereignty, but was overruled before the fact. Not to mention, how can this genius Kostunica tell us he was 'overruled' regarding an event he claims not to know was going to take place? Has Kostunica hired speech writers who used to work for the comedy team of Abbot and Costello? Abbot: I can't find my cookies. You wouldn't happen to know their whereabouts, would you Costello? Costello: How could you accuse me of eatin' them three chocolate chip cookies you hid under the napkins when I didn't know they was there? Does Kostunica mistake us for six year old children watching Saturday afternoon TV? If it is not, if it is in fact a sham, then it must be an instrument of NATO/Imperial rule; there is no third alternative. And if it is an instrument of Imperial rule, used to demonize and punish those who, coming from materially poor countries, nevertheless dare to resist U.S. control, then citizens of the NATO countries must act against it. Otherwise, shall we not share a shameful responsibility? (1) Below are excerpts from a joint press conference held April 30, 1999, by Louise Arbour, then Chief Prosecutor of the ICTY (The Hague 'Tribunal') and U.S. Secretary of State Madeline Albright. A) At the time, the United States and other NATO countries had spent five weeks perpetrating the main international crime: waging an aggressive war against a state which had invaded no other. Moreover the United States and its allies: * Bombed civilian facilities (a war crime) * Dropped anti-personnel weapons (a war crime) * Bombed a train and at least one refugee column (both war crimes) * Bombed Serbian TV (a war crime) * And deliberately created an environmental catastrophe by bombing chemical facilities in Pancevo (a war crime). In the press conference, Arbour made no reference to these publicly known war crimes. Instead she accepted as her only field of concern NATO's accusations against Yugoslavia. These accusations, which have been over and over exposed as without foundation, and even lies, were used to justify the crime of bombing Yugoslavia. B) In this highly visible forum, Albright instructed Arbour to indict President Milosevic. [Start quote from Albright] Well, obviously, the question of what is going to happen to Mr. Milosevic is a subject that is very much on our minds, and Justice Arbour knows what we have said both publicly and privately; that she and the Tribunal need to follow out the trail of evidence to its conclusion. We, as I said, are supportive of her efforts. [End quote from Albright] Instead of rejecting what would be a gross and humiliating interference if the 'Tribunal' were a real court, Arbour coyly (and shamelessly) linked the execution of said indictment with increased funding and help in gathering (or, one should say, fabricating) evidence: [Start quote from Arbour] We are here, and elsewhere, to ensure that we get the assistance to move the cases forward in that direction. Whether it points to any particular individual, I think the law is very clear: there is no immunity before our Tribunal for heads of state. Emperor's Clothes Dutch Expert: Milosevic Has A Good Case Introduction by Jared Israel [15 July 2001] On 12 July, Chris Black, head of legal work for the International Committee to Defend Slobodan Milosevic (ICDSM), held a press conference. He announced that Milosevic's Dutch lawyers would take action in the Dutch courts, contesting his kidnapping and incarceration at NATO's 'Tribunal' in The Hague. Black refused to reveal the details of Mr. Milosevic's strategy. The following article from a Dutch newspaper, in which an expert on international law discusses his possible strategy, is speculation, but interesting nonetheless. Note that the expert says: Strijards is of opinion the way the Tribunal has handled the extradition, has been 'very unfortunate'. The fact that the President of the Tribunal, judge Jorda, in advance and already before the lawsuit has started, to the media has declared that the extradition of Milosevic 'judicial legitimate' was, is according to Strijards unwise. 'Can you than speak of independent and impartial jurisdiction? He should have waited till the lawsuit.' Strijards' point is well taken; if anything, he understates. One of the main functions of the 'Tribunal' since its inception has been to issue statements and stage 'photo-opportunities' attacking the Serbs and supporting NATO. These attacks have included the crudest yellow-journalism, with Tribunal officials posing next to supposed mass grave sites and declaring that many bodies will be unearthed and that Serbian forces will be found guilty. The 'Tribunal' has been declaring President Milosevic guilty - and NATO innocent - as far back as the bombing of Yugoslavia. For example, a few weeks before the 'Tribunal' issued its indictment of Milosevich and other Yugoslav leaders, prosecutor Louise Arbour held a joint press conference with U.S. Secretary of State Albright. By Gertie Schouten Dutch morningpaper 'TROUW' Saturday, July 14, 2001 Slobodan Milosevic has good arguments when he shortly will demand his release before a Dutch judge. That is the opinion of Gerard Strijards, professor of international criminal law at the University of Groningen. First, Article 15 of the (Dutch) Constitution says that no one can be hold in detention, other than on basis of the Dutch law or judicial order, something that is not applicable on Milosevic. Second, according to Strijards, Milosevic can allege that he has been illegally 'kidnapped from his country. His extradition to the Yugoslav Tribunal is namely in violation with Article 2 of the (Dutch) Constitution, the Yugoslav law, and also Article 5 of the European Treaty of Human Rights, in which is laid down the right for every person to at least one time to appeal before a court, before his removal. Nevertheless, Strijards expect that the District Court, and in higher appeal the Federal Court and the Supreme Court will declare the case non-receptive, on the basis of the charter of the United Nations. Article 103 of the Charter - a 'guillotine-regulation' - stipulates that UN-regulations take precedents of the Dutch law, no matter the Dutch constitutional principles. However, it becomes interesting according to Strijards, when the lawyers of Milosevic in about a year of two, after all Dutch procedures have been finished, will end at the European court of Human Rights in Strasbourg. I this court there are also many judges from Eastern Europe and many of them are very critical of the Yugoslav Tribunal. This court could possibly decide that the detention of Milosevic indeed is in violation with fundamental rights. That could bring The Netherlands in a very difficult judicial position, when the European court demands his release against the wish of the Tribunal. To the glib unreality of CNN's standard coverage, with cameras at first lingering on Stately Buildings and a reporter who talked like the guy who narrated 'Lives of the Rich and Famous,' was added the faux-judicial atmosphere of the Tribunal, which looks like a movie set designed by an ad agency. What are they selling? 'Chairman' May was the perfect TV pitchman, delivering memorized lines with what someone called cut glass politeness. And of course, upper class British. That sells in the colonies. You will be accorded the full rights of the accused, according to international law, ' May promised Slobodan Milosevic plus hundreds of millions of viewers as if we were fools, as if in this theme park of a court room with its designer robes he was addressing a fellow actor instead of the man who led his country ten years resisting Washington's attempt to destroy it (during which Washington violated every known international law plus human decency). The full protections of international law, intoned May. As if Milosevic had not just been kidnapped and thrown in a cell, apparently without his heart pills. What are the rights of a kidnap victim under international law? These proceedings will be long and complex and you may wish to reconsider whether you want to have counsel, cooed the false May. The real Slobodan Milosevic answered, I consider this tribunal false tribunal and indictments false indictments. It is illegal, not being appointed by UN general assembly so I have no need to appoint council to illegal organ. May frowned. He explained to the three hundred million that of course this unwise decision to decline counsel could be reversed anytime because NATO's court was entirely fair minded and now would or would not Mr. Milosevic care to exercise his inalienable right to hear the lies fabricated against him? That's your problem, said Milosevic. May looked pained, meaning, 'Now do you see why we dropped uranium-encased bombs on them?' What is your plea? Answered Milosevic: This Tribunal aims to produce false justification for the war crimes of NATO committed in Yugoslavia. I asked you a question, said May, reminding the world that: 'The International Community's patience is not infinite.' As if the world didn't already know. I have given you my answer, replied Milosevic. Furthermore, this so-called Tribunal - - May hit the mike-cut button. The rules state that if an accused fail to enter a plea then the trial chamber will enter a plea of not guilty on his behalf. Milosevic replied, speaking in Serbo-Croatian. As I have said, the aim of this tribunal is to justify the crimes committed in Yugoslavia. That is why this is a false tribunal, and illegitimate - The translator hesitated a moment. This chorus includes not only the mainstream media, which uniformly supports the kidnapping, but also various groups and individuals who oppose the kidnapping. Their common view is that Kostunica was out of the loop; that the kidnapping was a big surprise or even an attack on him by Serbian Prime Minister Djindjic. The evidence doesn't support this view. KOSTUNICA BLAMES THE VICTIMS Yesterday Mr. Kostunica issued a statement on the kidnapping. In it he blamed everyone but himself. Remarkably, the blame extended to the Montenegrin Socialists (SNP). According to Kostunica, by refusing to support his proposed extradition law, the SNP had blocked an: opportunity to legally regulate cooperation with the tribunal so that our citizens could be protected. {Kostunica's statement, as translated by Emperor's Clothes} Huh? Mr. Kostunica's proposed law would have established regulations to speedily extradite anyone demanded by NATO's Hague Tribunal. How can that be portrayed as protecting citizens? When a government regulates Injustice, does that make it Just? In his statement, Kostunica whitewashed Washington and blamed Mr. Milosevic for getting kidnapped: From the arsenal of Milosevic's politics, which was truly defeatist for the state and the people, are now adopted and revived precisely its most undemocratic elements: illegality and the pulling off of humiliating maneuvers that no one in the international community asked for, at least not explicitly. {Ibid.} Huh? First of all, the international community definitely did demand Milosevic be brought to The Hague. And they praised the kidnapping once it happened. Why does Kostunica deny these publicly known facts? And what is the meaning of at least not explicitly? Second, as far as the kidnapping having roots in Milosevic's practices, what practices? Kostunica doesn't say. Did Milosevic kidnap people and send them to the Tribunal? No. Did he rule by decree? No. If Milosevic was such a terrible dictator, how come he didn't even arrest Mr. Kostunica, whose Presidential election campaign last year accepted tens of millions of illegal U.S. dollars, smuggled into Serbia in 'suitcases of cash?' If Vojislav Kostunica possessed facts implicating Milosevic in any crime he would have turned that evidence over to prosecutors. Therefore he had no evidence. Therefore Kostunica's constant accusations have been lies that relied on and reinforced the evidence of rumor and smear spread by the Western media and the Yugoslav media controlled by Mr. Djindjic and - Mr. Kostunica. Kostunica's accusations are frequently quoted in the Western media where they help NATO sustain anti-Milosevic (read: anti-Serb) public opinion. Why do Serbian patriots tolerate this man? If such a leader pretended to care about his country, isn't he all the more guilty? Mr. Kostunica openly participated in every step of the terrible crime of kidnapping of Slobodan Milosevic - including the final step, the deed itself. In the last step, after the kidnapping had been ordered halted by the Constitutional Court, Mr. Kostunica played the vital role. Was he present at the final planning meeting? We don't know. Some report he was. He says he wasn't. But whether he dirtied his hands with the actual details is irrelevant. The important thing, the vital thing, was that he NOT do his job as president. His job as President was to a) command the army and b) protect the constitution. Djindjic announced days before the kidnapping, and so did other leaders, that Milosevic would be kidnapped regardless of the decision of legal procedures. It was then Kostunica's duty to arrest these plotters and order the army to take control of the Belgrade Prison to make sure the publicly threatened action could not occur. That was precisely what Kostunica promised when he told the SPS two days and one day before the kidnapping that he would permit no unconstitutional action. He was like the sheriff of a town who knows the KKK plans to murder a black man and refuses to provide protection. His refusal to do his duty constitutes a crime just as conscious and serious as that of the flunkies who carry out the lynching - the only difference is, his superior position allows him not to dirty his hands. In a sense, perhaps, such a sheriff is worse than the actual lyncher. But in any case: in Washington Kostunica called for extradition and promised to fight for an unconstitutional law to allow it; then he tried to coerce the Montenegrin socialists to vote for the illegal law; then he condoned the illegal decree of the Federal Government; then he falsely promised to prevent kidnapping; and then (assuming he was not also one of the direct planners) he betrayed his oath and looked away while it happened And then - hypocrite! - he expressed shock and blamed everyone but: HIMSELF. FIRST - You assume he is basically what he appears - i.e., that he conceives his job as being president rather being US agent - and proceed from there to conclude the above. It reminds me of the assassination of Malcom X.. He had been threatened with death by Louis Farrakan, but at the crucial time, for some reason, his bodyguards were not present... Kostunica was the KEY man in this kidnapping. SECOND - Many people are now saying that the main thing here is not the extradition of Milsoevic it is the assault on Yugoslavia. I am pleased that people say this, but I also have my own view: that the removal of Milosvic was very important to the US because even in jail in Belgrade he could provide critical leadership to the SPS and because he had to be defeated because of what he signifies for people in vast setions of the world - people who DESIRE revolutionary change see him as a great rebel leader against the US empire. That is why hundreds of thousands of Ukrainians signed petitions demanding his release. In my opinion, he has not been defeated. He has been elevated in importance. Let's not shrink from challenging their demonization of him because they demonize him for a reason: in 1990 he led in the creation of a new, broader party that stood up to the U.S./German attempt to destroy Yugoslavia, instead of becoming a US flunky and aiding (with great regret!) that destruction - as Kostunica has done. The US and its puppies have been attacking him ever since. Protesters demanded: * No extradition to the Hague Tribunal! * Keep Kosovo in Serbia! * End Repression in Serbia! * End destruction of Yugoslav economy! * Free Slobodan Milosevic Now! People on the scene estimated about 50,000 were at the rally. This writer spoke by mobile phone to march Monitors who waited two hours for everyone to pass a given point. It was a very big demonstration. The marchers were driven by a passion for justice that elicited a like response from tens of thousands of onlookers. They cheered from balconies or joined in the streets, swelling the ranks as protesters marched to the jail where Slobodan Milosevic has been held 10 weeks without evidence, without charge, imprisoned, as prosecutors have now admitted, for the crime of resisting NATO. The mass media in Yugoslavia broadcasts ever more bizarre rumors of war crimes while leaders in Washington, Berlin and London, who committed the real war crimes of creating the terrorist Kosovo Liberation Army and bombing Yugoslavia, yank the strings of the Belgrade authorities. Contrary to news accounts, many of the marchers were young. When they got to the jail they tried to tear the fence down. March Monitors restrained them, believing this could be a trap set by the Belgrade authorities, who are increasingly isolated, under harsh pressure from NATO to produce results, and desperate. Once these 'Democrats' promised great improvements if Yugoslavia stopped opposing NATO. Now, in the ruin of the Yugoslav economy, they threaten disaster if Yugoslavia doesn't give Washington everything it wants. Belgrade is disgusted. CHRIS BLACK'S CREDENTIALS Mr. Black is a Canadian lawyer with a great deal of experience with and knowledge of the so-called International War Crimes Tribunals. He has written several papers on their structure, financing and role in the New World Order. Mr. Black is one of the group of lawyers, led by Professor Michael Mandel, who in May, 1999 brought war crimes charges against NATO leaders and officials for their responsibility for the criminal aggression against Yugoslavia. During the week of June 11, Attorney Black was in Belgrade on behalf of the International Committee to Defend Slobodan Miloshevich. TERRORISTS: ORGANIZED BY THE UN The 'Times' article states that at least 800 of the Albanians attacking Macedonia are members of the Kosovo Protection Corps: [These] KPC reservists were called up by their Albanian commander, Agim Ceku, in March. The Kosovo Protection Corps was created by the UN, or UNMIK, the UN apparatus in Kosovo. In creating the KPC, the UN simply adorned the Kosovo Liberation Army terrorists with new uniforms and equipment and a new name. Of course, their nature did not change: Murder, torture and extortion: these are the extraordinary charges made against the UN's own Kosovo Protection Corps in a confidential United Nations report written for Secretary-General Kofi Annan. The KPC stands accused in the document, drawn up on 29 February, of 'criminal activities - killings, ill-treatment/torture, illegal policing, abuse of authority, intimidation, breaches of political neutrality and hate-speech'. The 5,000-strong corps, funded by UN members including Britain, has a £30 million aid budget for Kosovo. It was set up to provide 'disaster response services'; instead, says the UN, it has been murdering and torturing people. (March 12, 2000) The above quote is from the London 'Observor.' Kofi Annan has not denied the existence of the UN report. Nor has he denied the truth of the charges against the KPC. But he has also not ordered the KPC dissolved. And, finally, and perhaps most damning, he has not punished the UN officials who made these terrorist-gangsters into a UN-sanctioned, UN-paid organization. And in doing so, who criminalized the UN. Now the KLA/KPC torturers and murderers have invaded Macedonia. Even if the UN hadn't officially organized the KPC, it is the sworn duty of UN officials to uphold the UN charter and try to prevent aggressive wars rather than hiring terrorists and giving them nice new uniforms in which to launch them.
